RESOLUTION NO.
WHEREAS, the City Council of the City of Newport Beach
did, pursuant to law, advertise for bids for the doing of certain
work of improvement, to —wit, the construction of a pier and storage
garage located on city owned property east of Tract No. 919 in the
city of Newport Beach; and
WHEREAS, said bide were opened at a regular meeting of the
City Council of the city of Newport Beach held on the 6th day of
October, 1941, at the time and in the manner provided for by the
notice inviting bids, and in accordance with the law in such cases
made and provided; and
WHEREAS, Smith Brothers of Newport Beach were the only
bidders for the doing of said work of improvement aforesaid; and
WHEREAS, the City Engineer of the city of Newport Beach
has informed the City Council that the work of improvement
aforesaid, may be more economically performed by the City of
Newport Beach by day labor, and the materials and supplies
necessary for the doing of said work, furnished at a lower price
the open market; and
WHEREAS, in the opinion of the City Council of the City
of Newport Beach the work of improvement heretofore mentioned
may be performed more economically by day labor and the materials
and supplies necessary for the doing of said work, furnished at a
lower price in the open market; and
WHEREAS, it is further the judgment and opinion of the
City Council of the city of Newport Beach that the bid of Smith
Brothers be, and the sameie hereby rejected for the reason that
in the opinion of the City Council, said bid is excessive and the
work of improvement may be done by the City by day labor and
materials and supplies obtained for the doing of said work on the
open market at a much lees price than that bid by Smith Brothers,
as aforesaid.

NOW, THEREFORE, BE IT RESOLVED: That the bid of Smith
Brothers for the doing ofsaid work of improvement heretofore
mentioned in this resolution, be and the same is hereby rejected.
BE IT FURTHER RESOLVED: That in the opinion and judgment
of the City Council of the city of Newport Beach the work of
improvement heretofore mentioned may be performed more economical:
by day labor by the city of Newport Beach, and that materials and
supplies necessary for the doing of said work may be obtained by
the city of Newport Beach at a lower price in the open market,
and that a considerable saving may be had by the City of Newport
Beach by the doing of said work on a day labor basis, as aforesai,
I hereby certify that the above and foregoing resolution
was duly and regularly passed and( dopfed by the City Council
I of the city of Newport Beach at a.'regulIar meeting thereof held
on the 20th day of October, 1941, by the following vote, to —wit:
