12 The City Council of the City of Newport Beach, pursuant
13 to the provisions of the Streets and Highways Code, Division 5,
14 Part 1, known as "Street Opening Act of 188911, does hereby resolve
15 and declare as follows:
I6 Section 1. That the public interest and convenience
17 requires the closing up and abandonment of a portion of a certain
Is alley in the city of Newport Beach, and it is the intention of the
19 City Council of the City of Newport Beach to order the following
20 described portion of a certain alley in said city to be closed up
21 and abandoned, to -wit:

All that portion of that certain alley fourteen (14)
23
feet in width, as said alley is laid out and shown on a map of
24
Tract No. 323, recorded in Book 14, pages 40 and 41, and a map of
25
Tract No. 470, recorded in Book 17, page 28 of Miscellaneous Maps,
26
Records of Orange County, California, described as follows, to -wit:

Beginning at the most westerly corner of Lot 1,
28 Block "C ", as shown on said map of Tract No.
470; thence southeasterly along the southwest -
29 erly line of said Block "C. ", 100.39 feet to the
southwesterly corner of Lot 2, of said Block "C ";
30 thence southwesterly along a line parallel with
the southeasterly line of Carnation Avenue, as
31 said avenue is shown on said map of Tract No. 470,
32 14.00 feet to a point in the northeasterly line of

NEWPORT BEACH DECLARING ITS INTENTION TO ORDER
THE CLOSING UP AND ABANDONMENT OF A CERTAIN ALLEY

IN THE CITY OF NEWPORT BEACH, LOCATED IN BLOCK "C ",
TRACT N0, 470, DECLARING IT TO BE FOR THE PUBLIC
6
INTEREST AND CONVENIENCE AND FIXING THE TIME AND
PLACE FOR HEARING OBJECTIONS TO SAID PROPOSED IM-
P
PROVEMENT, AND SPECIFYING THE EXTERIOR BOUNDARIES
OF THE DISTRICT OF LANDS TO BE AFFECTED OR GENE-

FITED BY SAID WORK OF IMPROVEMENT AND TO BE ASSESS-
ED TO PAY THE DAMAGES, COSTS AND EXPENSES THEREOF.

thence northwesterly along the northeasterly
line of said Lot 4, Block 731, 100.39 feet to
the most northerly corner of said Lot 4; thence
northeasterly in a direct line 14.00 feet to the
point of beginning.
RESERVING to the City of Newport Beach, California,
the right, privilege, and easement of maintaining,
operating, repairing, constructing and reconstruct-
ing water mains and pipe lines and sewerage mains
and pipe lines under, in, over, and along a strip
of land six (6) feet in width lying southwesterly
of, adjacent to, and parallel with the northeasterly
line of said alley.
All portions of said alley to be closed up and abandoned
are more clearly shown on a certain map approved and adopted by
the City Council of the City of Newport Beach for said closing up
and abandonment, by Resolution dated February 2, 1942, and
designated Resolution No. .
Section 2. That the exterior boundaries of the
district of lands to be affected or benefited by said work of
improvement and to be assessed to pay the damages, cost and
expenses thereof, are particularly described as follows, to -wit:
Beginning at the most westerly corner of Block 731,
as said block is shown on a map of Corona Del Mar,
recorded in Book 3, pages 41 and 42 of Miscellaneous
Maps, Records of Orange County, California; thence
northeasterly along the northwesterly line of said
Block 731, and the northeasterly prolongation of said
line a distance of 260.00 feet; thence southerly in
a direct line to the southeasterly corner of Lot 4,
Block "C ", as said Block "C" is shown on a map of
Tract No. 470, recorded in Book 17, page 28 of
Miscellaneoue Maps, Records of said County; thence
westerly Ih a direct line to the southwesterly corner
of said Lot 4, Block "C "; thence northwesterly In a
direct line to the point of beginning.
Section 3. That said proposed work of Improvement Is
for the closing up and abandonment of a portion of that certain
alley herelnabove more particularly described, and It appears to
the said City Council of the City of Newport Beach that no

Section 4
That the proceedings for the
closing up and

abandonment of the aforesaid portion of said alley
shall be had

and taken under and
in accordance with the Streets
and Highways
4
Code, Division 5, Part 1, known as "Street Opening
Act of 1889".

Section 5
The Street Superintendent of
the City of
6
Newport Beach shall
cause to be conspicuously posted along the
7 line of said contemplated work of improvement and at not more
8 than three hundred (300) feet in distance apart, but not less
9 than three (3) in all, notices of the passage of this resolution,
10 in the form and manner as required by law; and he shall also
11 cause a notice similar in substance to be published by inserting
12 said notice for four (4) successive times in the NEWPORT BALBOA
13 PRESS, a weekly newspaper published and circulated and of general
14
circulation in the City of Newport Beach, California, which said
15
newspaper is hereby designated for that purpose by the said City

Council of the city of Newport Beach, which said notice shall

contain a statement of the fact of the passage of this resolution

of intention, the date hereof, and briefly describing the work of

improvement proposed and referring to this resolution for further
20
particulars,

Section 6 That any person interested, objecting to
22
said work of improvement or to the extent of the district or lands
23
to be affected or benefited by said work of improvement, and to
24
be assessed to pay the cost and expenses thereof, may make
25
26 written objections to the same within ten (10) days after the
27 expiration of the time of the publication of said notice mentioned
28 in Section 5 hereof, which objections shall be delivered to the
29 Clerk of the City Council, who shall endorse thereon the date
30 of its reception by him, and at the next meeting of the City
31 Council, after the expiration of said ten days, lay said
32 objections before said City Council who shall fix a time for

hearing said objections, not less than one (1) week thereafter.
The City Clerk shall thereupon notify the persons making such
objections of the time and place of the hearing of said objections
by the City Council and notice of said hearing shall be given
by depositing a notice thereof in the Post Office of said City of
Newport Beach, postage prepaid thereon, addressed to said objector.
I hereby certify that the foregoing resolution was duly
and regularly passed and adopted by the City Council of the City
of Newport Beach at a regular meeting thereof held on the 2nd day
of February, 1942, by the following vote, to -wit:
