RESOLUTION NO.
WHEREAS, on the 3rd day of February, 1941, the City of
Newport Beach entered into an agreement of lease with one S. M.
Spalding, for dock and garage located on city owned property in
the city of Newport Beach; and
WHEREAS, the term of said lease was for three years
commencing as of March 1, 1941, at a rental of $648.00 per annum,
payable in advance each year; and
WHEREAS, the said S. M. Spalding has paid two years
rental on said garage and dock lease, which covers a period of
time from March 1, 1941, to and including March 1, 1943; and
WHEREAS, said agreement was made by the said S. M,
Spalding for the purpose of dockage for a schooner owned by him
and known as the RAMONA; and
WHEREAS, the said S. M. Spalding has represented to
the City of Newport Beach that the United States Navy has
chartered the schooner RAMONA from the said S. M. Spalding, taking
possession of said yacht without payment of any rental and entire-
ly at the risk of the owner, S. M. Spalding, for the duration of
the war; and
WHEREAS, said S. M. Spalding desires that said lease
be cancelled and declared of no further force or effect, without
the return or refund of any of the rental money heretofore
paid to the City of Newport Beach.
NOW, THEREFORE, BE IT RESOLVED that in consideration of
the premises and other valuable considerations, the City of
Newport Beach agrees to and does hereby cancel said lease with
the said S. M. Spalding, dated February 3, 1941, aforesaid, and
relieves and releases said S. M. Spalding from further payment of
rental under the terms thereof& and in accordance with the

application of said S. ME Spalding dated August 31, 1942, on file
in the office of the City Clerk of the city of Newport Beach,
reference being made to said application for further particulars
and the same is by such reference made a part hereof.
I hereby certify that the above and foregoing resolution
was duly and regularly passed and adopted by the City Council of
the City of Newport Beach at a regular meeting thereof held on the
day of September, 1942, by the following vote,to —wit:
