II RESOLUTION NO. L—'

3 WHEREAS, Charles Weinberg has made application to the
4 City Council of the City of Newport Beach for a cancellation of
5 taxes on the boat "Dolly ", Custom/No. 27E202, owned by him on the
6 first Monday in March, 1942, and docked in the City of Newport
711 Beach, Orange County, California, on said last mentioned date; and
8
WHEREAS, the said Charles Weinberg has represented to th
9
City Council of the City of Newport Beach that said boat "Dolly"
10
has been chartered by the Navy Department of the United States
11
Government for the duration of the war, and that he is receiving
12
no compensation for this charter from the Government; and
13
WHEREAS, said Charles Weinberg has asked for a can-
14
celle.tion of taxes on said boat Dolly for the reason that it is
15
now property owned by the United States Government; and
16
WHEREAS, Sections 4986 and 4986.2 of the California
17
Statutes of 1941, provide in substance that all or any portion
18
of any uncollected tax, penalty or costs heretofore or hereafter
19
levied, may, on satisfactory proof, be cancelled by the officer
20
having custody of the records of the City on order of the
21
governing body of the city with the written consent of the City
22
Attorney, on property acquired after the lien date by the United
23
States of America; and
24
WHEREAS, the City Council of the City of Newport Beach
25
has obtained satisfactory proof of the fact that said boat
26
DOLLY was on or about , chartered to the
27
Navy Department of the United States Government and the United
28
States Government, now has sole custody and control of said boat
29
and will continue to have sole custody and control of said coat
30
for the duration of the war; and

1 WHEREAS, it likewise appearing that the City Council
2 Of the city of Newport Beach has the right under the Statutes
3 aforesaid to cancel any portion of the tax lien on said boat
• 4 DOLLY by reason of the Pacts aforesaid, and that the City Attorney
5 of the City of Newport Beach has consented to such cancellation.
6 NOW, THEREFORE, BE IT RESOLVED: That the Auditor of the
7 City of Newport Beach be, and he is hereby authorized, directed and
8 instructed to cancel
50% of the taxes now due and owing from Charles
9 Weinberg to the City of Newport Beach on the boat DOLLY for the
10 fiscal year 19421943.

the City of Newport•Beach at a regular meeting thereof held on the
14
