3 WHEREAS, W. A. Wilgus has made application to the City
4 Council of the City of Newport Beach for a cancellation of taxes
5 on the boat ADE,LE W. II - -27 E 498, owned by him on the first
6 Monday in March, 1942, and docked in the City of Newport Beach,
7 Orange County, California, on said last mentioned date; and
8 WHEREAS, the said W. A. Wilgus has represented to the
9 City Council of the city of Newport Beach that said boat Adele W.II
10 has been chartered by the United States Coast Guard for the duratiox
11 of the war,and that he is receiving no compensation for this
12 charter from the United States Government; and
13 WHEREAS said W. A. Wilgus has asked for a cancellation of
14 taxes on said boat Adele W. II, for the reason that it is now
15 property owned by the United States Government; and
16 AREAS, Sections 4986 and 4986.2 of the California
17 Statutes of 1941, provide in substance that all or any portion
18 of any uncollected tax, penalty or costs heretofore or hereafter
19 levied, may, on satisfactory proof, be cancelled by the officer
20 having custody of the records of the City on order of the governing
21 body of the city with the written consent of the City Attorney, on
22 property acquired after the lien date by the United States of
23
America; and
24 WHEREAS the City ouncil of the City of Newport wport Beach has
25
obtained satisfactory proof of the fact that said goat ADELE W. II
26
was on or about August 9, 1942, chartered to the Navy Department
27
of the United States Government, and the United States Government
28
now has sole custody and control of said boat and will continue to
29
30 have sole custody and control of said boat for the duration of the
31 1 war; and

1 WHEREAS, it likewise appearing that the City Council of
2 the City of Newport Beach has the right under the Statutes
3 aforesaid to cancel any portion of the tax lien on said boat
4 ADELE W. II, by reason of the facts aforesaid, and that the City
5 Attorney of the city of Newport Beach has consented to such cancel.

7 NOW, THEREFORE, BE IT RESOLVED: That the Auditor of the
8 City of Newport Beach be, and he is hereby authorized, directed ani
9 instructed to cancel 50% of the taxes now due and owing from W. A,
10 Wilgus to the City of Newport Beach on the boat ADELE W. II, for
11 the fiscal year 19421943.

14 was duly and regularly passed and adopted by the City Council of
15 the City of Newport Beach at a regular meeting thereof held on
