CALIF. i a RESOLUTION NO. j WHEREAS, Frank Morgan has made application to the Oity Oouncil of the Oity of Newport Beach for a cancellation of taxes on the boat DOLPHIN,No. 227893, owned by him on the first Monday in March, 1942, and docked in the City of Newport Beach, Orange County, California, on said last mentioned date; and WHEREAS, the said Frank Morgan has represented to the City Council of the city of Newport Beach that the boat DOLPHIN has been chartered by the United States Navy for the duration of the war, and that he is receiving no compensation for this charter from the United States Government; and WHEREAS, said Frank Morgan has asked for a cancellation of taxes on said boat Dolphin for the reason that it is now property owned by the United States Government; and WHEREAS, Sections 4986 and 4986.2 of the California Statutes of 1941, provide in substance that all or any portion of any uncollected tax, penalty or costs heretofore or hereafter levied, may, on satisfactory proof, be cancelled by the officer having custody of the records of the city on order of the gover body of the city with the written consent of the City Attorney ,on property acquired after the lien date by the United States of America; and WHEREAS, the Oity Council of the City of Newport Beach has obtained satisfactory proof of the fact that said boat DOLPHIN was on or about July 25, 1942, chartered to the Navy Department of the United States Government, and the United States Government now has sole custody and control of said boat and will continue to have sole custody and control of said boat for the duration of the war; and 1. 1 M 1' 2 3 41 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 LAW OFFICES OF ROLAND THOMPSON 210 SPURGEON BLDG. CALIF. i 1 WHEREAS, it likewise appearing that the City Council of the City of Newport Beach has the right under the Statutes aforesaid to cancel any portion of the tax lien on said boat DOLPHIN by reason of the facts aforesaid, and that the City Attorney of the City of Newport Beach has consented to such cancellation. NOW, THEREFORE, BE IT RESOLVED: That the Auditor of the City of Newport Beach be, and he is hereby authorized, directed and instructed to cancel 50% of the taxes now due and owing from Frank Morgan to the city of Newport Beach on the boat DOLPHIN for the fiscal year 1942 -1943.
