WHEREAS, the City Council of the city of Newport Beach
now contemplates the development of certain tidelands located
in the Western portion of the city of Newport Beach by slant
or subterranean drilling from lands outside of the city limits
of the city of Newport Beach, for oil, gas and other hydro-
carbon substances, which tidelands the city claims title to; and
WHEREAS, it is proposed that said tidelands be developed
for oil, gas and other hydro - oarbon substances as aforesaid, by
a competent oil operator without expense to the city of Newport
Beach; and
WHEREAS, from information received from the city of Long
Beach, it would appear that considerable study, research and
preparation will be necessary in the preparation of legal work
in connection with the making, drawing and negotiating of said
proposed agreement by the city in reference to said tidelands,
and in determining the legal right of said city to lease said
tidelands for subterranean drilling; and
WHEREAS, said work of negotiation, preparation and
research work aforesaid, respecting said proposed agreement
for the development of said tidelands in the city of Newport
Beach by slant or subterranean drilling, constitutes, in the
opinion of the City Council of the city of Newport Beach, extra-
ordinary services and not contemplated in the salary allowed
to the city attorney; and
WHEREAS, it further appears from information had by
the City Council that the agreement aforesaid, is of a highly
technical character and that but few attorneys have had any
experience in the drawing of such agreements, and that the City
of Long Beach, by and through its attorneys, has spent many
months in the preparation of similar agreements; and

WHEREAS, the oil operator who is now requesting an
agreement for the development of said tidelands in said city,
has agreed to pay to the city any and all expenses which said
city may incur in connection with the preparation of proper
agreements for the development of said tidelands by slant
drilling, for oil, gas and other hydro— carbon substances.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the city of Newport Beach does hereby hire and retain
Roland Thompson, Esq., of Santa Ana, California, and Mason and
Houseman, of Long Beach, California, for the purpose of making
proper research relative to the city's legal right to develop
tidelands within said city, and in the preparation and
negotiation of an agreement or agreements for the development
of said tidelands, should it develop that the city has the
legal right to develop said tidelands for the purposes herein
stated, at a remuneration which shall not exceed $1500,00.
BE IT FURTHER RESOLVED that the money to be paid to
said attorneys be taken out of the moneys this day deposited
to cover costs in connection with the work herein mentioned.
I hereby certify that the above and foregoing
resolution was duly and regularly passed and adopted by the
City Council of the city of Newport Beach at an adjourned
regular meeting of said city Council held on the day of
July, 1943, by the following vote, to —wit:
