WHEREAS, FORREST E. JOHNSTON and CATHERINE L. JOHNSTON,

husband and wife have this day offered to the CITY OF NEWPORT

BEACH, the sum of $1100.00 for Lot 12, Block 438; Lot 17, Block
5
539; and Lots 3 and 5, Block 639; all in Corona del Mar, in the
6
City of Newport Beach, as shown on a Map recorded in Book 3, pages
7
41 and 42 of Miscellaneous Maps, records of Orange County,
8
California; and
9
WHEREAS, the said price is a fair and adequate price
10
as and for the purchase price of said lots; and
11
WHEREAS, the City Council of the City of Newport Beach
12
deems that it is for the best interests of said City that said
13
property be sold for the said sum of $1100.00; and
14
15 WHEREAS, the price offered is just, fair and adequate
16 and is not disproportionate to the real value of the property
above described.

18 NOW, THEREFORE, BE IT RESOLVED: That said property be
19 sold to the said Forrest E. Johnston and Catherine L. Johnston,
20 husband and wife, for the sum of $1100.00, free and clear of all
21 encumbrances, subject to the second half of the taxes for the
22 fiscal year 1943 -44. Also subject to conditions, restrictions
23 and reservations of record. The Mayor and the City Clerk are
24 hereby authorized and directed to execute and deliver a deed for
25 said property to the said parties upon receipt of the consideratioi
26 above set forth.
27 BE Ii FURTHER RESOLVED: That the sum of $200.00 be
28 paid to W. J. Holcomb, as and for his commission for the negotia-
• 29 ting of the sale of said real property to Forrest E. Johnston and
30 Catherine L. Johnston, his wife, as joint tenants, said sum being
31 a fair and reasonable commission to be allowed in said sale, and
32 I said broker being a licensed realtor of the City of Newport Bealoh.

I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council of
the City of Newport Beach at a regular meeting thereof held on the
7th day of February, 1944, by the following vote, to -wit:
