3 WHEREAS, there has been presented this day to the City
4 Council of the City of Newport Beach a certain agreement dated
5 the let day of March, 1945, between the City of Newport Beach ,
6 in said agreement referred to as party of the first part, and
7 William R. Hulbush of Corona Del Mar, in said agreement referred
8 to as the party of the second part; and
9 WHEREAS, said agreement refers to the handling, care
10 and disposal of dogs delivered to party of the second part by
11 party of the first part; and is for a period of one year from
12 and after March 1, 1945; and
13 WHEREAS, it appears to the City Council of the City of
14 Newport Beach that said agreement is in all respects just, fair
15 and equitable as between the parties thereto, and that it is for
16 the best interests of said City that the same be executed by said
17 City;
18 NOW, THEREFORE, BE IT RESOLVED, that the mayor and the
19 city clerk of the City of Newport Beach be, and they are hereby
20 authorized, directed and instructed to sign said agreement on
21 behalf of the city of Newport Beach,

THIS ACRi,?F!Z:vT, made and entered into this let day of
Icsarch, 1945, by and between the City of Newport Beach, a municipal
corporation, hereinafter referred to as the party of the first part,
and William R. Hulbush of Corona Del b_ar, California, hereinafter
Ireferred to as the party of the second part,

13H::.LCAS, the party of the second part is a licensed
veterinarian, having and maixtaining a dog hospital at 1006 Coast
Boulevard, Corona Del J;ar, in the City of 1:ewport Beach, California;
and
SIHLREAS, the City Council believes that the city has not
the proper facilities at this time to handle stray dogs under the
terms of Ordinance i -o. 473 of the City of Newport Beach;,and
.,HEREAS, the party of the second part represents and
warrants to the party of the first part that he is in all respects
able to care for, handle and dispose of stray dogs under the city
ordinances of the City of :;export Beach;

for and in consideration of the premises and other considerations
hereinafter wentioned, the party of the second part agrees and
covenants with the party of the first part to handle, care for
e,nd dispose of all dogs delivered to him by the policy Department
of the city of Yewport Beach as stray dogs or dogs which have
been picked up under the ordinances of the City of Few-port Beach.
The second party agrees With the first party to handle,
care for and feed all dogs delivered to him by the Police Depart-
ment of the City of F;eWport Beach, at the rate of 50¢ per dog per
day, and after said veterinarian has held said dogs for seventy -
tro (72) hoirs as provided for by Ordinance No. 473 of said city,
that he will dispose of said dogs by killing them in a humane
manner at the rate of ;,11.00 per dog.

The second party agrees and covenants with the first
pasty that he Mill, in handling said dogs, comply with all the
rules and regulations of the Police Department of the City of Tew--
port Beach, as well as all ordinances of the City of Newport Beach
and the Statutes of the State of California, and will handle all
dogs placed in his care or custody in a humane manner, and will
dispose of said dogs in a humane approved manner in case the killi
thereof becones necessary.
It is mutually ar_•reed between the parties hereto that
this agreement shall remain in full force and effect bet ^een the
parties hereto until February a89 1946, unless sooner terminated by
the parties hereto, and it is specifically understood between said
parties that dither party may terminate this agreement upon giving
a ten days written notice to the other party, and upon the giving
of said notice it is understood and agreed that this agreement
shall be terminated and ended and shall be of no further force or
effect for any purpose whatever.
It is further understood and agreed by and between the
parties hereto that for services rendered by the party of the
second part for the party of the first part in any month hereafter,
under the terms hereof, said party of the second part shall receive
his pay therefor on or before the 10th day of each month following
the date of this agreement, provided he shall have filed an
itemized statement with the Chief of Police of said city showing
the services rendered in connection witrh this agreement, and said
itemized statement shall have been approved by said Chief of
Police. Said itemized statement shall be filed not later than
the Friday preceding the first Honday of each month hereafter.
