`Wh.t;Ri,;AS, the City of Wewport Beach on the 2nd day of July,
1945;, passed its certain resolution of intention, id "o. j
declaring its intention to order the closing up, vacation and
abandonment of a portion of that certain alley 14 feet in ridth
in Block D in the City of Nerport Beach, pursuant to said in accord-
ance with the Street Vacation Act of 1941, approved Play 13, 1941,
statu6es of 1941, Chapter 250, being Division 9, Part 3, streets
and Highways Code; and,
t:Hr;ttrAS, the Street superintendent of the City of fewport
Beach has caused to be conspicuously posted along the line of said
alley proposed to be vacated, not less than 300 feet apart, and
not less than 3 in all, notices of the vacation of said alley, whir
said notices so posted stated the passage of.said Resolution of
Intention and the time and place of the hearing, all of which will
more fully appear from the affidavit of H. L. Patterson, Street
Superintendent, on file in these proceedin�:s; and
CTil;f AS, the City Council of the City of Kewport Beacil,
by said Resolution of Intention aforesaid,.did fix 11onday, the
6th day of August, 1945, at the hour of 4:00 o'clock P. i.. of said
day, in the Council Chambers of the City Council of the City of
Newport Beach, located in the City Hall of the City of ;:erport
Beach, as the time and place for the hearing of all persons interes
ed in or objecting to the proposed vacation of said alley; and

said, has been published at least once in the i�!ewport- Balboa i1?ews
Times, a newspaper of general circulation printed, published and
circulated in the City of NelTport Beach, and said publication ras
made before the date set for the hearing of all persons interested
in or objecting,• to the proposed vacation, all of which will more

fully appear by the affidavit of S. A. 1 =eyer, printer and publisher
of said Newport- Balboa Heirs Tires, on file in these proceedings;
and,
I,jf1k;HZA8, the City Council has heard the evidence, both
written and verbal, by all persons interested in the vacation of
said alley in this Resolution more particularly hereinafter
described, and finds from all of the evidence submitted that said
alley described in the Resolution of Intention, and hereinafter
described, is unnecessary for present or prospective street purposeE
IJ01i, TH&L&FO: the City Council of the City of iiewport
Beach finds acid determines and hereby orders: That the following
described portion of a certain alley in the City of Yewport Beach,
described as follows:
All that portion of alley 14 feet in width in Block D,
as shown upon map of Tract Wo. 323, Kiscellaneous :-aps,
Book 14, Pages 40 and 41 and Block 632, as shown upon
map of Corona del ::ar, 1iscellaneous :,aps, Book 3, Pages
41 and 42, Records of Orange County and described as
follows:
Beginning at the most southerly corner of Lot 3, Block D
of Tract Yo. 323, thence northwesterly on a straight line
to a point, said point lying in the southeasterly line
of Lot 14, Block 632, Corona del i:ar and being 23.10 feet
southwesterly from the most easterly corner of said Lot 14,
thence northeasterly along said southeasterly line to said
most easterly corner of Lot 14, thence northwesterly along
the northeasterly line of said Lot 14, a distance of 35.78
feet to a point, thence northwesterly on a straight line
to the most westerly corner of Lot 3, Block D, Tract 323,
thence southeasterly along the southwesterly line of said
Lot 3, a distance of 71.46 feet to the corner of Lot 3,
thence southwesterly at right angle to last mentioned line,
a distance of 46.14 feet to point of beginning.
is unnecessary for present or prospective public street purposes,
and now makes its Order Vacating said alley.
The City Council further finds and determines and tt
is hereby ordered that the public easement in the alley heretofore
described has, upon the passage of this Resolution, ceased, and the
title to said land herein described shall, and the same does hereby
revert to the respective owners thereof, free from the public ease-
ment for street purposes.

The City Council further orders that the City Clerk of the
City of Newport Beach shall cause a certified copy of this order
duly attested by him as City Clerk under the seal of the City to
be recorded in the office of the County Recorder of Orange County,
State of California, immediately following the passage of this
resolution.
The above and foregdng Resolution Yo. 3 17as
passed at a regular meeting of the City Council of the City of
Vewport Beach, held on the qth day of ek te'r1945, by the follow-
