RESOLUTION NO.3 �
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, FIXING THE RATE PER CENTUM AND
LEVYING A TAX UPON ALL OF THE TAXABLE PROPERTY
WITHIN THE CITY OF NEWPORT BEACH WHICH IS TAXABLE
THEREIN FOR MUNICIPAL PURPOSES.
The City Council of the City of Newport Beach does
resolve and declare as follows:
FIRST: Resolved, that there be and is hereby levied upon
all of the taxable property within the City of Newport Beach which
is taxable therein for municipal purposes, a tax for the purpose o
raising the necessary money with which to carry on the various
departments of the City of Newport Beach for the current fiscal
year. 1945 -1946.
SECOM : Resolved, that the rate per centum of the tax
hereinafter levied shall be and is hereby fixed as the sum of
One Dollar five cents ($1.05) on each one hundred dollars of value
designated for each fund as follows:
For
current expense fund:
One Dollar
($1.00)
For
the library fund:
Five cents
( .05)
Total tax levy: One Dollar five cents($1.05)
THIRD: Resolved, that in addition to all other taxes
herein levied for municipal purposes, there is hereby levied on
all of the taxable property within the city of Newport Beach, a
tax for the purpose of raising the necessary and sufficient money
to pay the annual interest on all issued, outstanding and unpaid
municipal bonds of the City of Newport Beach, and also such part
of the principal thereof as shall become due before the time for
fixing the next general tax levy in and for said City, the rate
hereby levied for said purposes is fixed at six cents (6¢) on
each one hundred dollars ($100.00) of value, and the same shall be
collected at the same time and in the same manner as all other
municipal taxes are collected, excepting upon property annex5d

at an election held the 11th day of February, 1924, and known as
Corona Del Mar, provided, that the said taxes herein levied
shall be exclusive of any tax levied for the payment of interest
and principal of $160,000.00 bonds of the City of Newport Beach
issued and sold for the completion of the municipal water system
thereof, and $240,000.00 bonds for the City of Newport Beach
issued and sold for the construction and improvement of jetties
in the city of Newport Beach and known as the Jetty Bonds of 1927,
and $50,000.00 bonds of the City of Newport Beach, for the
acquisition, construction and completion by the City of Newport
Beach of a certain municipal improvement, to -wit, the improvement
of the municipal harbor by deepening and dredging the channel,
and by the acquisition and construction of various groins for the
purpose of controlling the tide and protecting the existing jetties
and shore lands, and including for said purpose the acquisition of
lands and rights of way, which said bonds are known and designated
as Newport Beach Harbor Improvement Bonds of 1929, and bonds in
the amount of $120,000.00 for the acquisition and construction
of a municipal improvement, to -wit, additions to the municipal
sewer system including the acquisition of lands and rights of way,
and the acquisition and construction of a main sewer line and
discharge sewer lines, a sewage disposal plant, sewage works,
pumping plants and buildings and equipment necessary or convenient
for said project, which said sewer bonds are known and designated
as Newport Beach Municipal Sewer Bonds of 1935,and bonds in the
amount of $100,000.00 of the City of Newport Beach, for the
acquisition and construction and reconstruction of two (2) public
piers, including the reconstruction and extension of the existing
piers into the waters of the Pacific Ocean, including buildings
structures necessary or convenient for saidprojeot, which said
bonds are known and designated as Pier Bonds, 1940.

FOURTH: Resolved, that in addition to all other taxes
herein levied for municipal purposes, there is hereby levied on all
of the taxable property within the City of Newport Beach a tax for
the purpose of raising the necessary and sufficient money to pay
the annual interest on $160,000.00 bonds of the City of Newport
beach, issued and sold for the completion of the municipal water
system thereof, issued, outstanding and unpaid of the City of
Newport Beach, and also such part of the principal thereof as

shall become due before the time of fixing the next general tax
levy in and for said city, and for the further purpose of paying
the annual interest of $50,000.00 bonds of the City of Newport
Beach, issued and sold for the improvement of the harbor of the
City of Newport Beach, and the construction of various groins
for the purpose of controlling the tide and protecting the existing
jetties and shore lands, issued, outstanding and unpaid of the city
of Newport Beach, and known as the Newport Beach Harbor Improvement
Bonds of 1929, and also such part of the principal thereof, as
shall become due before the time of fixing the next general tax
levy in and for said city, and also a tax for the purpose of raisin,
the necessary and sufficient money to pay the annual interest on
$120,000.00 bonds of the City of Newport Beach, issued and sold
for the acquisition and construction of a municipal improvement,
to -wit, additions to the municipal sewer system including the
acquisition of lands and rights of way, and the acquisition and
construction of a main sewer line and discharge lines, a sewage

disposal plant, sewage works, pumping plants and buildings and
equipment necessary or convenient for said project, which said
sewer bonds are known and designated as Newport Beach Municipal
Sewer bonds of 1936, issued, outstanding and unpaid of the City
of Newport Beach, and also such part of the principal thereof as
shall become due before the time of fixing the next general tax
levy in and for said city, and also a tax for the purpose of
raising the necessary and sufficient money to pay the annual in-
terest on $100,000.00 bonds of the City of Newport Beach, issued
and sold for the acquisition and construction of a municipal
improvement, to -wit, the acquisition, construction and reoonstruo-
tion of two (2) public piers, including the reconstruction and
extension of the existing piers into the waters of the Pacific
Ocean, including buildings and structures necessary or convenient
for said project, which said pier bonds are known and designated
as Pier Bonds, 1940, issued, outstanding and unpaid of the City
of Newport Beach, and also such part of the principal thereof as

The rate of tax hereby levied for the purpose of paying
the interest and principal of said water bonds, and said jetty
bonds, and said Newport Beach Harbor Improvement Bonds of 1929,
and Newport Beach Municipal Sewer Bonds of 1936. and Pier Bonds,
1940l as aforesaid, is hereby fixed at thirty -four cents (34¢) on
each one hu{tdred dollars ($100.00) of value.
FIFTH: Resolved, that in addition to all other taxes
herein levied there is hereby levied on all the taxable property
within the City of Newport Beach, a tax of ten cents (100) on
each one huiidrdd dollars ($100.00) for advertising purposes, pursu
to the provisions of Ordinance No. 144 submitted to and carried by
a majority of the votes of all the voters voting at an election
held for the purpose of voting for or against said ordinance on

SIXTH: Resolved, that in addition to all other taxes
11herein levied, there is hereby levied on all of the taxable
property within the City of Newport Beach a tax of three cents (3¢)
on each one hundred dollars ($100) of assessed valuation, for park
purposes, pursuant to the provisions of Ordinance.No. 380 of the
City of Newport Beach, submitted to and carried by a majority of
the votes of all voters voting at an election held for the purpose
of voting for or against said ordinance on May 28, 1938.
SEVENTH: Resolved, that in addition to all other taxes
therein levied, there is hereby levied on all of the taxable
property within Municipal Improvement District No. 2 of the City
of Newport Beach, a tax of seven cents (7¢) on each one hundred
dollars ($100) of assessed valuation for the payment of semi-
annual interest on and the redemption of the bonds of said district
EIGHTH: Resolved, that in addition to all other taxes
herein levied, there is hereby levied on all of the taxable
property within Municipal Improvement District No. 3 of the City
of Newport Beach, a tax of Fourteen cents (14¢) on each one
hundred dollars ($100) of assessed valuation, for the payment
of semi - annual interest on and the redemption of the bonds of said
district.
NINTH: Resolved, that in addition to all other taxes
herein levied, there is hereby levied on all of the taxable
property within Municipal Improvement District No. 7 of the City
of Newport Beach, a tax of nineteen cents (19¢) on each one hundr
dollars ($100) of the assessed valuation lair the payment of semi-

TENTH: Resolved, that in addition to all other taxes
herein levied, there is hereby levied on all of the taxable lands
within the assessment district created by Resolution of Intention
No. 622 of the City of Newport Beach, in the matter of Acquisition

and Improvement District No. 1 of the City of Newport Beach, a
levy of special assessment taxes of One Dollar ($1.00) on each
$100.00 of the total assessed value of said lands within said
district, exclusive of the improvements thereon, for the purpose
of creating a special fund for the payment of principal and
interest on bonds issued in accordance with law, and the said
Resolution of Intention No, 622 of the City of Newport Beach,
in the matter of Acquisition and Improvement District No. 1 of the
City of Newport Beach,
ELEVENTH: In addition to all other taxes herein levied,
there is hereby levied upon all of the taxable property within the
City of Newport Beach a tax of fifteen cents (150) on each one
hundred dollars ($100.00), said amount being sufficient to raise
the amount estimated by the City Council of the City of Newport
Beach as being sufficient to raise the amount estimated by the City
Council to be required to provide sufficient revenue to meet the
obligation of the City to the Retirement System under Section
58 -o of the uState Employees Retirement Act", Statutes of 1931,
page 1442, and amendments thereto, as well as sufficient under
sub- seotion 5 of Section 38 -0 of the same Act, and said rate of
taxation is in addition to the annual rate of taxation allowed by
law to be levied in the City of Newport Beach.
The above and foregoing resolution was passed, adopted
and approved by the City Council of the City of Newport Beach, at
a regular meeting thereof field on the 4th dayof September, 1945,
by the following vote, to -wit:
