RESOLUTION N0j)-69)_
WHEREAS, the City of Newport Beach is the record owner of
the real property hereinafter described, which property is
described as all that certain real property situate in the City
of Newport Beach, County of Orange, State of California, and liiore
particularly described as follows, to -wit:
Lot 16 in Block 9, Re- subdivision of Section 1,
Balboa, L. E. B. 6 - page 30, Records of Orange
County
by virtue of that certain deed from the City Tax Collector to the
City of Newport Beach recorded January 13, 1941, in Book 1071,
page 520 Of Official Records, and that certain deed from the Coun
Tax Collector to the City of I`Tewnort Beach duly recorded February
8, 1941, in Book 1076, page 458 of Official Records; and
i$E EAS, Griffith,Company, a California Corporation, held
Bond 112 of Series No. 22 of the City of NewT=t Beach, which
bond they contended was delinquent; and
IMERLAS, Griffith Company did, on or about the 20th day of
February, 1945, file an action against one Edgar A. McNulty, as
Administrator of the estate of Florence E. _cDermott,.also known
as Florence k1cDermett, Deceased, et al, Defendants, for the
foreclosure of said Bond 112 of Series No. 22 aforesaid, which
case is Case Yo. 43815 in the Superior Court of the State of
California in and for the County of Orange; and
5HER &AS said property was sold under judgment of this
Court in said action No. 43815, and in said judgment the Court
authorized a foreclosure on said bond and made an order of sale
the real property heretofore described; and
17HEREAS, after proceedings duly had and taken, said pronert
was sold by the Commissioner as provided by said judgment and o
of sale, to one Fred D. Kyle for the sum of Twenty -Six Hundred
Dollars (1?2,600.00), and after the costs had been deducted there-
from and the amount of said judgment of said Court had been paid,

there remained on hand the sum of Tyro Thousand Four Hundred Two
and 15/100 Dollars (.;2,402.15), which sum ryas, under Order of Cour
duly deposited in Court for the benefit of those persons who might
be entitled thereto; and
RHEREAS, the said City of Newport Beach, as record owner
of said property, believes that it is entitled to said surplus
funds so deposited in Court as aforesaid;
NOTI, THEREFORE, BE IT RESOLVED that the City Attorney, in
the'name of said City of Newport Beach, be authorized, directed,
and instructed to bring all necessary actions or proceedings in
the name of said City of Newport Beach for the recovery of said
sum of Two Thousand Four Hundred Two and 15/100 Dollars (;2,402.15,
as aforesaid.
