3 A RESOLUTION OF INTENTION OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH DECLARING ITS IN-
4 TENTION TO ORDER THE CLOSING -UP, VACATION AND
ABANDONMENT OF CERTAIN ALLEYS, STREETS AND
5 EASEMENTS FOR PUBLIC UTILITY PURPOSES IN TRACT
6 NO. 907, PURSUANT TO AND IN ACCORDANCE WITH THE
"STREET VACATION ACT OF 1941.°

8 The City Council of the City of Newport Beach, pursuant
9 to the provisions of the "Street Vacation Act of 194111, approved
10 May 13, 1941, Statutes of 1941, Chapter 250 and amendments thereto#
11 being Division 9, Part 3, Streets and Highway Code, does hereby
12 Resolve and Declare as follows
13 Section 1. That the public interest and convenience requires the
14 closing -up and abandonment of certain alleys, streets and easements
15 to the City of Newport Beach for public utility purposes, Tract
16 No. 907 in the City of Newport Beach, California, and it is the
17 intention of the City Council of the City of Newport Beach to
18 order the following described alleys, streets and easements to the
19 City of Newport Beach for public utility purposes in said city to
20 be vacated, closed up and abandoned, to -wit:

22 VIA OPORTO
23 All that portion of Via Oporto as shown upon a
map of Tract No. 907, recorded in Book 28, pages
24 25 to 36 inclusive, of Miscellaneous Maps, Records
of Orange County, California, lying between the
26 prolongation of the southerly line of Via Lido
across said Via Oporto and the south line of said
26 Tract No. 907.
27 VIA MALAGA
28 All of Via Malaga, as shown upon a map of Tract
No. 907, recorded in Book 28, pages 25 to 36 in-
29 clusive of Miscellaneous Maps, Records of Orange
County, California.

ALLEY
31 All that certain alley, 20 feet in width, as-laid
32 out and shown upon a map of Tract No. 907, recorded
in -Book 28, pages 25 to 36, inclusive of Miscellaneous
Maps, Records of Orange County, California,

extending between the westerly prolongation of a
line parallel with the northerly line of Lot 1183
of said Tract -No. 907, said parallel line being
7.50 feet south of the northwest-corner of said
Lot'1183 and the westerly prolongation of the
south line of Lot 1192 of said Tract No. 907.
ALLEY
All that certain alley 20 feet in width, as laid
out and shown upon a map of Tract -No. 907, re-
corded in Book 28, pages 25 to 36 inclusive of
Miscellaneous Maps, Records'of-Orange County,
California, lying adjacent to Lots 1201 to 1208
inclusive, and Lots 1211 to 1214 inclusive, of
said Tract No. 907.
EASEMENTS
All those certain easements 4 feet in width, dedi-
cated to the City of Newport Beach for public
utility purposes, as shown upon a map -of Tract
No. 907, recorded in Book 28, pages 25 to 36 in-
clusive, -of Miscellaneous Maps, Records of Orange
County, California, extending across Lots 1184
to 1196 inclusive, and Lots 1205 to 1214 inclusive,
and along the westerly side of Lot 1183, extending be-
tween a line parallel with and 7.5 feet south of the
northerly line of said Lot 1183 and the south line
of said Lot 1183, and along the south line of Lot 1184
and along the east line of Lot 1195 of said Tract`
No. 907.

All portions of said alleys,/and easements to the City of
Newport Beach for public utility purposes to be vacated, closed up
and abandoned, are more clearly shown on a certain map approved and
adopted by the City Council of the City of Newport Beach for said
vacation, closing up and abandonment, by the Resolution dated
January 7, 1946 and designated Resolution No. 3 Reference
is hereby made for further particulars as to the proposed vacation,
closing up, and abandonment,to said map, and said map is made a
part of this Resolution to the same extent and purpose as if the
same were herein incorporated in full.
Section 2. That the proceedings for the closing -up and abandonmen
of the aforesaid alleys, streets and easements to the City of
Newport Beach for public utility purposes, shall be had and taken,
and the City Council of the City of Newport Beach elects to pro -
coed under the provisions of the "Street Vacation Act of 1941",

approved May 13, 1941, Statutes of 1941, Chapter 250 and amendments
thereto,.being Division 9, Part 3, Streets and Highway Code.
Section 3. The Street Superintendent of the City of Newport Beach
shall cause to be conspicuously posted along the line of the alleys
streets and easements to the City of Newport Beach for public
utility purposes proposed to be vacated, not less than 300 feet
apart, but not less than three in all, notices of the vacation
of said alleys, streets and easements to the City of Newport
Beach for public utility purposes. Said notices shall state the
passage of this Resolution of Intention and the time and place
of the hearing of all persons interested in or objecting to the
proposed vacation of said alleys, streets and easements to the
City of Newport Beach for public utility purposes, all as required
by law.
Section 4. NOTICE IS HEREBY GIVEN that the City Counci f the

City of Newport Beach does hereby fix ?� vlthe _ day
of va�v , 1946, at the hour of _ o'clock P. M. of said
day, in the Council Chamber of the City of Newport Beach, located
in the City Hall in the City of Newport Beach, as the time and
place for hearing all persons interested in or objecting to the
proposed vacation of said alleys, streets and easements to the
City of Newport Beach for public utility purposes. And the said
City Council at said time and place will hear the evidence offered
by any person interested in the vacation of said alleys, streets
and easements to the City of Newport Beach for public utility
purposes heretofore described.
Section 5. This Resolution of Intention shall be published at
least once in the Newport- Balboa News Times, a newspaper of general
circulation printed, published and circulated in the City of
Newport Beach, and said publication shall be made before the date
set for the hearing of all persons interested in or objecting to
the proposed vacation.

The above and foregoing Resolution of Intention No. 37--10.
was passed at a regular meeting of the City Council of the City of
Newport 'Beach, held on-the _ day of h a , 1946, by the

regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
