RESOLUTION ORDERING VACATION
WHEREAS, the City of Newport Beach on the k2th day of
November, 1946-, passed its certain Resolution of Intention NO-11
declaring its intention to order the closing up, vacation, and
abandonment of portions of Ocean Front, in.the City of Newport
Beach, pursuant to and in aocordance with the 98treet Vacation Act
of 194111, approved May 13, 1941, Statutes 1941, Chapter 250 and
amendments thereto, being Division 9, Part 3, Chapters 2 and 3,
Sections 8320 to 8331, inclusive, Streets and Highways Code;.and
WHEREAS, the Street Superintendent of the City of Newport
Beach has caused to be conspicuously posted along the line of said
street, not more than 300 feet apart, and not less than three in
all, notices of the Vacation of said portions of said street, all
of which will more fully appear from the affidavit of

Newport Beach, on file in these proceedings; and
WHEREAS, said notices so posted by the Street Superinten-
dent of the City of Newport Beach, stated the passage of said
Resolution of Intention No. a05 aforesaid, and the date and
place of the hearing of all persons interested in or objecting to
the proposed vacation of said portions of said street; and
WHEREAS,.the City Council of the City of Newport Beach by
said Resolution of Intention aforesaid, did fix Monday, the-23t�d:

day of De.demer, 194q, at the hour of four o'clock P. M. of said

day, in the Council Chambers of the City Council of the City of
Newport Beach, located in the City Hall of the City of Newport
Beach, as the time and place for the hearing of all persons
interested in or objecting to the proposed vacation of &8Ad por-
tions of said street; and
,WHEREAS, said Resolution of Intention No.bJ ". aforesai
has been published at least once in the Newport Balboa,Ne s- Times,

1 a newspaper of general circulation printed, published, and oiroular
• 2 ted in the City of Newport Beach, and said publication was made
3 more than fifteen days before the date set for the hearing of all
. 4 persons interested in or objecting to the proposed vacation, all

7 in these proceedings-; and - _ - - - 1.
8 WHEREAS, the City Council has heard the evidence, both
9 written and verbal, by all persons interested in the vacation of
10 said portions of said street in this Resolution more particularly
11 hereinafter described, and finds from all the evidence submitted
12 that said portions of said street described in the Resolution
13 of Intention, and hereinafter described, are unnecessary for

-14 present or prospective street purposes;
15 NOW, THEREFORE, the City Council of the City of Newport
16 Beach finds and determines and hereby orders: That the following
17 described portions of a certain street in the City of Newport
18 Beach, described as follows:
1911 PORTIONS OF STREET TO BE VACATED:
20 Those certain parcels of land, being portions
of Ocean Front, as shown upon a map of Seashore Colony
21 Tract recorded in Miscellaneous Maps, Book 7, Page 25,
Records of Orange County, California, which said parcels
22 are more particularly described as follows, to -wit:

Parcel No. 1: Beginning at the most southerly corner of
Lot 1, Block A of said Seashore Colony

Tract; thence, northwesterly along the northeasterly
line of said Ocean Front to the most westerly corner of

Lot 6, Block A of said Seashore Colony Tract; thence,
southwesterly along the southwesterly prolongation of

the northwesterly line of said Lot 6 to a point, said
point lying in a line parallel with and distant 10.00

feet measured at right angles from said northeasterly
line of Ocean Front; thence, southeasterly along said

parallel line to its intersection with the southwesterly
prolongation of the southeasterly line of said Lot 6;

thence southwesterly along said southwesterly prolongation
of the southeasterly lineof said Lot 6, to a point, said

point lying in a line parallel with and distant 15.00
feet measured at right angles from said northeasterly line

of Ocean Front; thence, southeasterly along said parallel
line to its intersection with the southwesterly prolonga-

tion of the southeasterly line of said Lot 1; thence, north-
easterly along said line of prolongation to the point of
beginning.

ly along said line of prolongation to the point of beginning.

1811are unnecessary for present or prospective public street purposes,
19 11and now makes its order vacating said portions of said street
20 II described.
21 The City Council further finds and determines, and it is
22 hereby ordered, that the public easement in the portions of said
23 street heretofore described has, upon the passage of this Resolu-
24 tion, ceased, and the title to the lands herein described shall,
25 and the same does hereby revert to the- respeo -tive owners thereof,
26 free from the public easement for street purposes.
27 The City Council further orders that the City Clerk of
. 28 the City of Newport Beach shall cause a certified copy of this
29 order, duly attested by him as the City Clerk, under the seal of
30 the City, to bteoorded in the office of the County Recorder of
31 Orange County, State of California, immediately following the
32 11 passage of this Resolution.
