RESOLUTION ORDERING VACATION

WHEREASO the City of Newport Beach, on the'i'r day of
M , 1947, passed its certain Resolution of In-
tention No, �_, declaring its intention to order the closing
up, vacation and abandonment of portions of Ocean Front, in the
City of Newport Beach, pursuant to and in accordance with the
"Street Vacation Act of 1941 ", approved May 13, 1941, Statutes
1941, Chapter 250 and amendments thereto, being Division 9, Part
3, Chapters 2 and 3, Sections 8320 to 8331, inclusive, Streets
and Highways.Code; and
WHEREAS, the Street Superintendent of the City of Newport
Beach has caused to be conspicuously posted along the line of
said street, not more than 300 feet apart, and not less than three
in all, notices of the vacation and abandonment of said portions
of said Ocean Front, all of which will more fully appear from the
affidavit of L. W. Covert, the Street Superintendent of said City
of Newport Beach, on file in these proceedings; and
WHEREAS, said notices so posted by the Street Superintendent
of the City of Newport Beach, stated the passage of said Resoluti
of Intention No. z aforesaid, and the date and place of the
hearing of all persons interested in or objecting to the proposed
vacation and abandonment of said portions of said Ocean Front; and
WHEREAS, the City Council of the City of Newport Beach by
said Resolution of Intention aforesaid, did fix Monday, the 24th
day of November, 1947, at the hour of 4 o'clock P. M. of said day,
in the Council Chambers of the City Council of the City of
Newport Beach, located in the City Hall of the City of Newport
Beach, as the time and place for the hewing of all persons inter-
ested in or objecting to the proposed vac tion of said portions of
said Ocean Front; and

1 WHEREAS, the hearing of all persons interested in or object-
40 2 ing to the proposed vacation and abandonment of said portions of
z� 3 said Ocean Front was legally held by the City Council of the City
4 of Newport Beach at the hour of 4 o'clock P. M. on Monday, the
5 aU� day of a �S,a , 1947, at the Council Chambers of
6 the City Council of the City of Newport Beach, located in the City
7 Hall of the City of Newport Beach; and
8 WHEREAS, said Resolution of Intention No. 'i/ aforesaid,
9 has been publishes at least once in the Newport Balboa News- Times,
10 a newspaper of general, circulation printed, published and cirou-
11 lated in the City of Newport Beach, and said puolication was made
12 more than fifteen days before the date set for the hearing of all
13 persons interested in or objecting p � g to the proposed vacation and
14 abandonment, all of which will more fully appear by the affidavit
15 of Sam D. Porter, printer and publisher of said Newport Balboa
16 News - Times, on file in these proceedings; and
17 WHEREAS, the City Council has heard the evidence, both
18 written and verbal, by all persons interested in the vacation and
19 abandonment of said portions of said Ocean Front in this Resolution
20 more particularly hereinafter described, and finds from all the
21 evidence submitted that said portions of said Ocean Front described
22 in the Resolution of Intention, and hereinafter described, are
23 unnecessary for present or prospective street purposes;
24 NOW THEREFORE, the City Council of the City of Newport Beach
25 finds and determines and hereby orders: That the following de-

scribed portions of Ocean Front in the City of Newport Beach,

described as follows:

Parcel No. 1; Beginning at the.most southerly corner
29 of o 1, loci A of said Seashore Colony Tract, thence
northwesterly along the northeasterly line of said Ocean
30 Front to the most westerly corner of Lot 6, Block A of said
Seashore Colony Tract; thence southwesterly along the
31 southwesterly prolongation of the northwesterly line of said
Lot 6 to a point, said point lying in a line parallel with
32 and distant 10.00 feet measured at right angles from said
northeasterly line of Ocean Front; thence southeasterly

shore Colony Tract; thence southwestei!ly along the south-
westerly prolongation of the northwesterly line of said Lot
3 to a point, said point lying in a line parallel with and
distant 15.00 feet measured at right angles from said
northeasterly line of Ocean Front; thence southeasterly along
said parallel line to its intersection with the southwesterly
prolongation of the southeasterly line of said Lot 2; thence
northeasterly along said line of prolongation to the point
of beginning.
Parcel No. 3: Beginning at the most southerly corner of
Lot , B oec B of said Seashore Colony Tract; thence north-
westerly along the northeasterly line of said Ocean Front
to the most westerly corner of said Lot 5; thence southwesterly
along the southwesterly prolongation of the northwesterly
line of said Lot 5, to a point, said point lying in a line
parallel with and distant 15.00 feet measured at right angles
from said northeasterly line of Ocean Front; thence south-
easterly along said parallel line to its intersection with

are unnecessary for present or prospective street purposes, and
now makes its order vacating said portions of said Ocean Front de-
scribed.
The City Council further finds and determines; and it is
hereby ordered, that the public easement in the portions of said
street heretofore described has, upon the passage of this Resolu-
tion, ceased, and the title to the lands herein described shall,
and the same does hereby revert to the respective owners thereof,
free from the public easement for street purposes.
The City Council further orders that the City Clerk of the
City of Newport Beach shall cause a certified copy of this order,

City, to be recorded in the office of the County Recorder of
Orange County, State of California, immediately following the
passage of this Resolution.
The above and foregoing Resolution No.9was passed
at a regular meeting of the City Council of the City of Newport
