RESOLUTION OF AWARD OF CONTRACT
NO. 3615
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA
AWARDING THE CONTRACT FOR THE WORK DESCRIBED IN
RESOLUTION OF INTENTION NO. 3605
RESOLVED, that the City Council of the City of Newport Beach
California, having in open session on the 13th day of September, 19
publicly opened, examined and declared all sealed proposals or bids
for the following work to be done and improvements to be made in sa
City, to -wit:
The grading, paving, construction of curbs, gutters, storm
drain structures, together with appurtenant work in connection with
any and all items of improvement herein mentioned, in Santa Ana
Avenue and other streets, alleys and easements, in Newport Heights,
all as more particularly described in Resolution of Intention No.
3605, passed and adopted by the City Council of said City on the 26
day of July, 1948, and on file in the office of the City Clerk of
said City.
For further particulars, reference is hereby made to said
Resolution of Intention No. 3605 and to the plans, profiles and
dings on file in the office of the City Engineer of said City of
(Newport Beach and to the specifications for the said work heretofore
adopted by the said City Council and on file in the office of the
City Clerk of said City, and all of said plans, profiles, drawings
and specifications heretofore approved by the City Council of said
City are incorporated herein and made a part hereof, and reference
is hereby made thereto for a more particular description of said
work.
Said City Council has determined and declared that the
11 contemplated work and improvement heretofore mentioned was in the
opinion of said City Council of more than local or ordinary public

benefit, and the said City Council has made the expenses of said
work chargeable upon a district. For the particular description
of the said district, reference is hereby made to said Resolution
of Intention No. 3605.
Said Council has determined and declared that serial bonds,
bearing interest at the rate of six (6) per cent per annum and ex-
tending over a period ending nine (9) years from the second day of
January next succeeding the next October 15th following their date,
will be issued hereunder in the manner provided by the "Improvement
Act of 1911 ", being Part 5, Division 7 of the Streets and Highways
Code of the State of California, to represent each assessment of
Twenty -five ($25.00) Dollars or more remaining unpaid for thirty
(30) days after the date of the warrant.
All of the work herein ordered shall be done and carried
through in pursuance of an Act of the Legislature of the State of
California, designated the "Improvement Act of 1911 ", being Division
7 of the Streets and Highways Code.
Said City Council hereby rejects all of the said proposals
for bids, except the next hereinafter mentioned, and hereby awards
contract for the said work and improvement to the lowest, regular
responsible bidder, to -wit: To Sully- Miller Contracting Company
at the prices named in said bid for said work, on file in
„the office of the City Clerk of said City.
The City Clerk of said City is hereby directed to cause a
NOTICE OF AWARD of contract to be published in the manner and form
required by said Code, by two insertions in the "Newport- Balboa Pre
a weekly newspaper published and circulated in said City of Newport
Beach and hereby designated for the purpose by the said City Counci
PASSED AND ADOPTED by the City Council of the City of
Beach, California, at a regular meeting thereof, held on the 13th
day of September, 1948, by the following vote, to -wit:
