RESOLUTION NO. 3616
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA,
ADOPTED PURSUANT TO THE PROVISIONS OF SECTION 2808
OF THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION
AND MAJORITY PROTEST ACT OF 1931 ", DIVISION 4 OF THE
STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA
WHEREAS, the City Council of the City of Newport Beach,
California, has received a communication from the Health Officer of
Orange County (who acts as Health Officer in the City of Newport
Beach under an agreement with said County), and which communication
is in words and figures as follows:

Gentlemen:
As Health Officer of the County of Orange, who also acts
as Health Officer for the City of Newport Beach, I hereby
recommend that proceedings be instituted at once for the
construction of two sewage pumping plants; one located
near the intersection of 14th Street and Central Avenue;
and one located near the intersection of "A" Street with
said Central Avenue, together with the construction of a
sewer main in said Central Avenue between "B" Street and
the pumping station to be constructed at the intersection
of "A" Street and Central Avenue, this sewer main to
relieve the present overloaded sewer trunk line along
Central Avenue between said points.
The existing sewage pump stations constructed some twenty -
five years ago at the above - mentioned intersections have now
become totally inadequate to take care of the necessary
sewage delivered to them. Not only have the pumps become
practically useless, but the wet walls of said pump stations
are totally inadequate in size, design or equipment to care
for the ever increasing load upon said stations.
I make this recommendation as a measure necessary for the
protection of public health, and it is also made pursuant
to Section 2808 of the Streets and Highways Code of the
State of California. I have made an investigation of both o
these pump stations above noted, and find that sewage is not
adequately handled through these pump stations and the City
is experiencing difficulties of properly relieving the trunk
lines of sewage delivered to said pump stations.

AND, WHEREAS, the City Council has duly considered the said

I communication, and has received information from the City Engineer
3
with reference to the proposed sewer improvements, referred to in
4
said communication:

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
6
BEACH, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE
7
AND ORDER AS FOLLOWS:

SECTION 1. That the improvements referred to in said
9
communication above quoted, is the construction of sanitary sewer
10
mains and sewage pump stations and appurtenant work in portions of
11
Central Avenue, as particularly shown and delineated on Plan and
12�
Profile No. 423, consisting of 7 sheets, heretofore approved by the
13
City Council and now on file in the office of the City Engineer of
14
1 said City.

SECTION 2. That said City Council does hereby find and
I
16
determine that the construction of said sanitary sewer mains and
17
sewage pump stations and incidental work in connection therewith,

and each of them, is necessary as a health measure, and such necess
19

for such construction is found to exist.

SECTION 3. That the City Clerk is hereby authorized and
21
instructed to spread the contents of said original communication
22
Jupon the minutes of this meeting of the said City Council, at which
23
this Resolution is adopted.

SECTION 4. That this Resolution is adopted under and pur-

suant to the provisions of Section 2808 of the "Special Assessment
26
Investigation, Limitation and Majority Protest Act of 1931 ",
27
Division 4 of the Streets and Highways Code of the State of Cal_;_fnr

and the City Council in adopting the same intends to meet each and
•
29
every condition and to make each and every finding necessary on its
30
part in order to permit the proceedings for said sewer improvements
31
to go forward to completion without further reference to, or appli-
32
cation of the provisions of said Division 4 of said Streets and
Highways Code.

13th day of September, 1948, by the following votes, to -wit:
