RESOLUTION NO. 3673
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH, CALIFORNIA,
ADOPTED PURSUANT TO THE REQUIREMENTS
OF THE "SPECIAL ASSESSMENT INVESTIGATION,
LIMITATION AND MAJORITY PROTEST ACT OF
1931 ", BEING PART 2, DIVISION IV OF THE
STREETS !`STD HIGHI•TAYS CODE OF THE STATE
OF CALIFORNIA.
1•7HEREAS, the City Council of the City of Newport Beach,
California, having heretofore instructed the City Engineer in the
matter of the proposed improvement of a portion of M Street and
certain alleys in East Side Addition to the Balboa Tract and Tracts
Nos. 518, 948, and 1090, to procure the data and prepare a written
report pursuant to the provisions of the "Special Assessment Invest
gation, Limitation and Majority Protest Act of 1931 ", being Part 2,
Division IV of the Streets and Highways Code of the State of Calif -
ornia, and thereafter the said City Engineer presented to this City
Council the said written report; and
1- ?HEREAS, pursuant to the provisions of said Section 2,
Division IV of said Streets and Highways Code, the City Council
shall, by resolution or ordinance, determine in general the nature,
location and extent of the proposed improvement; generally define
the boundaries or extent of the district or lands to be specially
assessed to pay the costs thereof, or any part of such costs; and
determine the statute under which it is proposed to conduct the
1proceedings for such improvement; and for the issuance of bonds
therein, if any.
NON, THEREFORE, BE IT RESOLVED AND DETERMINED BY THE CITY
COUNCIL OF THE CITY OF NEG?PORT BEACH,CALIFORNIA, as follows:
1. That the written report, presented by the City
for the proposed improvement herein referred to, is hereby approved
and it is hereby ordered that said report be filed in the office of
the City Clerk for public inspection.

2. That the proposed improvement herein mentioned
is generally described as:
(a) Grading, paving with plant mix material,
installation of house sewer connections and
water connections, and appurtenant work in
connection there *wi.th; in
2.LLEYS
in Blocks Nos. 23, 24, 26, 27 and 28 of East Side
Addition to the Balboa Tract; and in the
ALLEYS
lying Easterly and Westerly of Tract no. 1090
between Central Avenue and Miramar Drive; and
in the first
ALLEY
lying Northerly of Miramar Drive between the alley
lying Easterly of said Tract No. 1090 and Central
Avenue; and in the first
ALLEY
lying Easterly of Lots 29 to 41, both inclusive,
of Tract No. 948; and in the first
ALLEY
lying Northeasterly of Lots 67 to 72, both inclusive,
of said Tract No. 948; and in the first
ALLEY
lying Southerly of Lots 74 to 80, both inclusive,
of said Tract no. 948; and in the first
ALLEY
lying 1•7esterly of Lots 81 to 86, both inclusive,
of said Tract No. 948; and in the
ALLEY
in Block B of Tract No. 518; and in the

between the produced Southwesterly line of the
first alley lying Southerly of Ocean Boulevard
and a line drawn 15 feet Southwesterly from the
Southwesterly line of said Ocean Boulevard.
(b) The construction of cement concrete alley aprons
at the following locations, to -wit; in
G STREET
at the Westerly end of the alley in said Block 24
of the East Side Addition to the Balboa Tract; and in
I STREET
at the Westerly end of the alley in Block 26 of
said East Side Addition to the Balboa Tract; and in
M STREET
at the Uesterly end of the first alley lying
Southwesterly of Central Avenue, and at the
Easterly end of the first alley lying Southerly
of Ocean Boulevard; and in
L STREET
at the Easterly end of the first alley lying
Voutherly of Central Avenue; and in
I STREET
at the Westerly end of the first alley lying
Southerly of Ocean Boulevard; and in
G STREET
at the Westerly end of the first alley lying
Southwesterly of Ocean Boulevard.
3. That all of said work and improvement, proposed to be done,
shall be constructed along the lines, between the points and at
the places shown on Map Igo. 425, consisting of 6 sheets, filed with
said report and by this reference made a part of this resolution.

4. That the district or lands to be specially assessed
to pay the costs of said proposed improvement is shown upon Map No.
425, consisting of Sheets Nos. 2 to 7, both inclusive, filed with
and forming a part of said written report. Reference is hereby
made to said map for a further, full and more complete description
of said assessment district, and the said map so on file shall
govern for all details as to the extent of the said assessment
district.
5. That the proposed improvement shall be done under the
provisions of the "Improvement Act of 1911 ", being Division VII of
the Streets and Highways Code of the State of California.
6. That serial bonds, bearing interest at the rate of six
per cent (6/) per annum and extending over a period ending nine
(9) years from the second day of January next succeeding the next
October fifteenth following their date, shall be issued hereunder
in the manner provided by the said "Improvement Act of 1911 ", being
Part 5 of Division VII of the said Streets and Highways Code to
represent each assessment of Twenty -five Dollars ($25.00), or
more, remaining unpaid for thirty (30) days after the date of
recording the assessment warrant.
7. That the said City Council hereby fixes Monday, the
9th day of May, 1949, at the hour of eight o'clock (8:00) P.M. as
the day and hour, and the Council Chamber of the City Council in
the City Hall of said City as the place of hearing on the written
report of the City Engineer, and hereby orders such hearing to be
held by the City Council of said City.
PASSED AND ADOPTED by the City Council of the City of
Newport Beach, California, at a regular meeting thereof, held on
the 28th day of March, 1949, by the following vote, to- i�rit:
