HomeMy WebLinkAbout3701 - Vacation and Abandonment Lancaster's1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 29 30 31 32 REsoLunaff No. 3 70 t RESOLUTION ORDERING VACATION WEEMS, the City of Newport Beach on the 9th day of May, 1949, passed its certain Resolution of Intention No. 349 I'D , declRring its intention to order the closing up, vacation, and abandonment of a part of a street in Lancaster's Addition, in Newport Beach, and hereinafter more particularly iescribed, pursuant to and in accordance with the "Street Vacation Act of n, approved May 13, 1941, Statutes 1941, Chapter 2$0 and amendments thereto, Division 9, Part 3, Chapters 2 and 3, Sections 8320 to 8331, inclusive, Streets and Highways Code; and WHEREAS, the Street Superintendent of the City of Newport Beach has ed to be conspicuously posted along the line of said street, not more than feet apart, and not less than three in all, notices of the vacation of said of said street, all of which will more Hilly appear from the affidavit of W. Covert, the Street Superintendent of said City of Newport Beach, on file these proceedings; and WHEREAS, said notices so posted by the Street Superintendent of the City Newport Beach, stated the passage of said Resolution of Intention No. 0 B L9 and the date and place of the hearing of all persons interested in or ing to the proposed vacation of said part of said street; and WHEREAS, the City Conn ail of the City of Newport Beach by said Resolution Intention aforesaid, did fix Monday, the 27th day of June, 1949, at the hour 7:30 P.M. of said day in the Council Chambers of the City Council of the City Newport Beach, located in the City Hall of the City of Newport Beach, as the ie and place for the hearing of all persons interested in or objecting to the vacation of said part of said street;.and WHEREAS, said Resolution of Intention No. 3 G i O, aforesaid, has been ablished at least once in the NEWPORT- BAIMOA PRESS, a newspaper of general irculation printed, published, and circulated in the City of Newport Beach, ad said publication was made more than fifteen days before the date set for he hearing of all persons interested in or objecting to the proposed vacation, 11 of which Sill more Hilly appear by the affidavit of Ben Reddick, owner and of said Newport - Balboa Press, on file in these prodeed.ings; and WHEREAS, the City Council has heard the evidence, both written and verbal, Y1 1 • 2 Ah 3 INW 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 by all persons interested in the vacation of said part of said street in this resolution more particularly hereinafter described, and finds from all the evidence submitted that said part of said street described in said Resolution of Intention, and hereinafter described, are unnecessary for present or pub tic prospective /street purposes: NOW, THER1PTORF., the City Council of the City of Newport Beach finds and determines and hereby orders; that the following described part of a certain street in the City of Newport Beach, described as follows: Beginning at the northwesterly corner of Lot 30, Block 530, Lancaster's Addition to Newport Beach, as shown upon a map of said Tract recorded in Miscellaneous Map Book 5, Page 14, Records of Orange County, California; thence northerly along the northerly prolongation of the westerly line of said lot 30 a distance of (11) eleven feet to the beginning of a curve concave to the south east, having a radius of (15) fifteen feet; thence along said curve a distance of 23.56 feet through a central angle of 900 to a point, said point being in a line 26 feet measured at right angles northerly of and parallel to the northerly lines of Lots 30 to 14 inclusive of said Black 530; thence easterly along said parallel line to the beginning of a curve concave to the southwest having a radius of (40) forty feet,' said curve also being tangent to the easterly line of Lot 14 of said Block 530; thence along said curve to an intersection with the northerly line.of said Lot 14; thence westerly along the northerly line of said Lots 14 to 30 inclusive to the point of beginning. is unnecessary for present or prospective public street purposes, and now makes its order vacating said part of said street described. The City Conseil further finds and determines, and it is hereby ordered, that the public easement in the part of said street heretofore described has, upon the passage of this Resolution, ceased. The City Council further orders that the City Clerk of the City of Newport Beach shall cause a certified copy of this order, duly attested by him as the City Clerk, under the seal of the City, to be recorded in the office of thb County Recorder of Orange County, State of California, immediately following the passage of this resolution.
