3 DECLARING ITS INTENTION TO ORDER CONSTRUCTION
OF CERTAIN PUBLIC IMPROVEMENTS IN "M" STREET
4 AND CERTAIN ALLEYS IN EAST SIDE ADDITION TO
BALBOA TRACT AND TRACTS NOS. 518, 948, AND 1090
5 IN SAID CITY: DECLARING THE ?IOEK TO BE OF MORE
THAN LOCAI, OR ORDINARY PUBLIC BENEFIT AND
6 DESCRIBING THE DISTRICT TO BE BENEFITED BY
SAID ?-'ORK AND TO PAY THE COSTS !SID EXPENSES ,
7 AND FIXING A TIME AND PLACE FO^ HEARING
OBJECTIONS TO SAID WORK.
9 The City Council of the City of Newport Beach, pursuant to
10 the provisions of the "Improvement Act of 1911", being Division VII
11
of the Streets and Highways Code of the State of California, does
12
resolve as follows:
13I SECTION 1. That the public interest and convenience requi
14
and it is the intention of the City Council of the City of D ?ee*oort

Beach, California, to order the following work to be done, to -wit:

DESCRIPTION OF WORK
17
First: The grading, paving with 2" plant mix material
18
laid upon a 5" untreated rock base, construction of cement concrete
19
curb, and appurtenant work in connection therewith; in
20
"M" STREET
21
between Ocean Boulevard and the Easterly prolongation of the Souther
22
ly line of the first alley lying Southerly of Ocean Boulevard, as
23
shown on Sheet No. 8 of the plans hereinafter referred to.
24
Second: The grading, paving with 2" plant mix material
25
laid upon a 5" untreated rock base, installation of house sewer
26
connections and water connections, and appurtenant work in connectie
27

SAND SPECIFICATIONS

SECTION 2. All of the said work and improvement to be don
17
shall be constructed upon the grades, along the lines, between the
18
points, of the dimensions, at the places and in the manner shoran on
19
the plans, profiles and drawings for the construction of said improv
20
ments, being Plan No. 425, consisting of nine (9) sheets, and
21
Standard Plans Nos. 1005 and 1061, on file in the office of the City
22
Engineer of said City and, except as otherwise provided on said plan
23
in further accordance with the specifications for the construction
24
of said improvements, said specifications being on file in the offic
25
of the City Clerk of said City, and to which plans, profiles, draw -
26
ings and specifications heretofore approved by the City Council of
27
the said City, reference is hereby made for a further, full and more
•
28
particular description of the said work, and by reference thereto
•
29
the same are incorporated herein and made a part hereof.

DESCRIPTION OF ASSESSMENT DISTRICT
31
SECTION 3. That the said contemplated work and improvemen
32
in the opinion of the said City Council, is of more than local or
ordinary public benefit, and the said City Council hereby makes the
expenses of said work and improvement chargeable upon a district,

which said district the said City Council hereby declares to be the

district benefited by said work and improvement and to be assessed
•

to nay the costs and expenses thereof, and which district is describ
4
as follows:

All that certain territory of the City of Newport Beach,
6
California, exclusive of streets and alleys, included within the
7
exterior boundary line shown upon that certain man or Plat No. 425,
8
consisting of Sheets Nos. 2 to 7 inclusive, attached to and forming
9
a part of the Investigation Report, prepared and filed under the pro
10
visions of the "Special Assessment, Investigation, Limitation and
11
Majority Protest Act of 1931 ", Division IV of said Streets and
12
Highways Code, heretofore approved by the City Council of said

City on the 28th day of March, 1949, indicating by said boundary
14
line the extent of the territory included within the proposed
15I
assessment district, and which map or plat is on file in the office
ld
of the City Clerk of said City. Reference is hereby made to said
17I
map or plat for a further, full and more particular description of
18
the said assessment district, and the said map or plat so on file
19
shall govern for all details as to the extent of the said assessment
20
I district .

DESCRIPTION OF BONDS
22
SECTION 4. That serial bonds, bearing interest at the
23
rate of six per cent (6 %) per annum, shall be issued to represent
24
leach assessment of Twenty -five Dollars ($25.00) or more, remaining
25

unpaid for thirty (30) days after the date of the warrant. Said
26
serial bonds shall extend over a period ending nine (9) years from
27
the second day of January next succeeding the next October f:if-teenth
•

following their date. Payments on the principal of unpaid assess-
.

ments and interest thereon shall be made by property owners to the
30
City Treasurer, and the same shall be disbursed by said City
31
Treasurer, and the same shall be disbursed by said City Treasurer,
32
all as provided in the "Improvement Act of 1911 ", hereinafter
referred to.

TIME AND PLACE OF HEARING
SECTION 5. NOTICE IS HEREBY GIVEN, that on the 8th day
Of August, 1949, at the hour of seven - thirty (7:30) o'clock P.M.
in the Council Chamber of the City Council, in the City Hall of
said City of NeNlport Beach, any and all persons having any objection
to the proposed work or improvement, or to the extent of the assess-
ment district, or to the proposed grades, may appear and show cause
why said work should not be done or carried out in accordance erlth
this Resolution of Intention. Protests must be in writing and must
be delivered to the City Clerk prior to the time set for the he
IMPROVEMENT ACT
SECTION 6. That all of the work herein proposed shall be
done and carried through in pursuance of an act of the Legislature
of the State of California, designated the "Improvement Act of 1911"
being Division VII of the Streets and Highways Code of the State of
California.
PUBLICATION OF RESOLUTION OF INTENTION
SECTION 7. The "Newport Balboa- Press ", a weekly newsp
printed, published and of general circulation in the City of Newport
Beach, California, is hereby designated as the newspaper in which
this Resolution of Intention shall be published by the City Clerk,
in the manner and form provided by law, and for making all other
publications in the proceedings under this Resolution of Intention.
The City Clerk is directed to mail notices of the
Of this Resolution of Intention to all persons owning real property,
proposed to be assessed, whose names and addresses appear on the
last equalized assessment roll for City Taxes, all in the manner
and form provided for under Sections 5070, 5194 and 5195 of the said
"Improvement Act of 1911 ", of said Streets and Highways Code.
POSTING OF NOTICE OF IMPROVEMENT
SECTION 8. The Superintendent of Streets of the City of
IlNewport Beach shall cause to be conspicuously posted along the line
0 f said contemplated work or improvement and along all open streets

N-rlthin the district liable to be assessed for said work, notices of

the passage of this Resolution of Intention, in the time, form and

manner provided by said Code.

SECTION 9. That the written report of the City Engineer
5
of the City of Newport Beach on the proposed improvements herein
6
described and prepared, pursuant to the provisions of the "Spacial
7
Assessment Investigation, Limitation and Majority Protest Act of
8
1931 ", being Division IV of the Streets and Highways Code of the
9
State of California, as modified by order of the City Council of
10
said City, adopted May 23, 1949, is on file in the offices of the
11
City Clerk of said City and open to public inspection.

PASSED AND ADOPTED by the City Council of the City of
13
Newport Beach, California, at the regular meeting thereof, held this
14
11th day of July, 1949, by the following vote, to -wit:
