RESOLUTION OF INTENTION NO. 3768.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, DECLARING ITS IN-
TENTION TO ORDER CONSTRUCTION OF SIDE14ALK AND
CURB IN OCEAN FRONT IN SAID CITY: DECLARING
THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY
PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO
BE BENEFITED BY SAID WORK AND TO PAY THE COSTS
AND EXPENSES, AND FIXING A TIME AND PLACE FOR
HEARING OBJECTIONS TO SAID WORK.
The City Council of the City of Newport Beach, pursuant
to the provisions of the "Improvement Act of 1911 ", being Division 7
of the Streets and Highways Code of the State of California, does
resolve as follows:
SECTION 1. That the public interest and convenience
require, and it is the intention of the City Council of the City of
Newport Beach, California, to order the following work to be done,
to -wit:
DESCRIPTION OF WORK
The construction of cement concrete sidewalk and curb,
lin the Northeasterly side of
OCEAN FRONT
between the Northwesterly line of Thirtieth Street and the South-
easterly line of Thirty -sixth Street.
PLANS, PROFILES, DRAWINGS
AND SPECIFICATIONS
SECTION 2. All of the said work and improvement to be
done shall be constructed upon the grades, along the lines, between
the points, of the dimensions, at the places and in the manner show
on the plans, profiles and drawings for the construction of said
improvements in Ocean Front, being Plan No. 427 consisting of one
(1) sheet, on file in the office of the City Engineer of said City,
and except as otherwise provided on said plans in further accordanc
with the specifications for the construction of said improvements,
said specifications being on file in the office of the City Clerk

said City and to which plans, profiles, drawings and specifications,

heretofore approved by the City Council of said City, reference is

hereby made for a further, full and more particular description of
4
said work and by reference thereto, the same are incorporated herein
5
and made a part hereof.

DESCRIPTION OF ASSESSMENT DISTRICT

SECTION 3. That the said contemplated work and

improvement, in the opinion of said City Council, is of more than
9
local or ordinary public benefit, and the said City Council hereby
10
'makes the expenses of said work and improvement chargeable upon a
11
district, which said district the said City Council hereby declares
12
to be the district benefited by said work and improvement and to be
13
assessed to pay the costs and expenses thereof, and which district
14lis
described as follows:

1 All that certain territory of the City of Newport Beach
16
California, exclusive of streets and alleys, included within the
17
exterior boundary line shown upon that certain map or plat No. 427,
18
consisting of one (1) sheet, attached to and forming a part of the
19
Investigation Report, prepared and filed under the provisions of
20
the "Special Assessment Investigation, Limitation and Majority Prote
t
21
Act of 1931 ", Division IV of said Streets and Highways Code, hereto -
22
fore approved by the City Council of said City on the 27th day of
23
December, 1949, indicating by said boundary line the extent of the
24
iterritory included within the proposed assessment district, and
25
(which map or plat is on file in the office of the City Clerk of
26
said City. Reference is hereby made to said map or plat of said
• 27
assessment district, and the said map or plat so on file shall
28
govern for all details as to the extent of the said assessment
29
district.

DESCRIPTION OF BONDS

SECTION 4. That serial bonds, bearing interest at the
32
rate of six per cent (6 %) per annum, shall be issued to represent ea

assessment of Twenty -five Dollars ($25.00) or more remaining unpaid

for thirty (30) days after the date of recording the warrant. Said

serial bonds shall extend over a period ending nine (9) years from

the second day of January next succeeding the next October fifteenth
4
following their date. Payments on the principal of unpaid assess -
5
ments and interest thereon shall be made by property owners to the C

Treasurer, and the same shall be disbursed by said City Treasurer,
7
all as provided in the "Improvement Act of 1911 ", hereinafter referr
8
ed to.

TIME AND PLACE OF HEARING

SECTION 5. NOTICE IS HEREBY GIVEN, that on the 27th
11
day of March, 1950, at the hour of seven - thirty o'clock (7:30) P.M.,
12
in the Council Chambers of the City Council in the City Hall of said
13
City of Newport Beach, any and all persons having any objections to
14
the proposed work or improvement or to the extent of the assessment
15
district, or to the proposed grades, may appear and show cause why
16
said work should not be done or carried out in accordance with
17
this Resolution of Intention. Protests must be in writing and must
18
be delivered to the City Clerk prior to the time set for the hear -
19
ing.

I IMPROVEMENT ACT

1 SECTION 6. That all of the work herein proposed shall
22
be done and carried through in pursuance of an act of the Legislatur
23
of the State of California, designated the "Improvement Act of 1911"
24
being Division 7 of the Streets and Highways Code of the State of
25
California.

PUBLICATION ('RESOLUTION OF INTENTION

SECTION 7. The "Newport- Balboa Press ", a weekly
28
newspaper, printed, published and of general circulation in the City
• 29
of Newport Beach, California, is hereby designated as the newspaper
30
in which this Resolution of Intention shall be published by the City
31
Clerk, in the manner and form provided by law and for making all
32
other publications in the proceedings under this Resolution of
Intention.

The City Clerk is directed to mail notices of the

adoption of this Resolution of Intention to all persons owning real
•

property proposed to be assessed, whose names and addresses appear
4
on the last equalized assessment roll for city taxes, all in the
5
manner and form provided for under Sections 5070, 5194, and 5195 of
6
the said "Improvement Act of 1911 ", of said Streets and Highways
7
Code.

POSTING OF NOTICE OF IMPROVEMENT

SECTION 8. The Superintendent of Streets of the City
10
of Newport Beach shall cause to be conspicuously posted along the
11
line of said contemplated work or improvement and along all open
12
streets within the district liable to be assessed for said work,
13lnotices
of the passage of this Resolution of Intention, in the time,
14
form and manner provided by said Code.

INVESTIGATION REPORT
16
SECTION 9. That the written report of the City Enginee
17
of the City of Newport Beach on the proposed improvements herein
18
described and prepared, pursuant to the provisions of the "Special
19
Assessment Investigation, Limitation and Majority Protest Act of
20
1931 ", Division IV of the Streets and Highways Code of the State of
21
California, is on file in the office of the City Clerk of said City
22
and open to public inspection.

PASSED AND ADOPTED by the City Council of the City of
24
(Newport Beach, California, at a regular meeting thereof held this
25
27th day of February, 1950, by the following vote, to -wit:
