CITY OF NEWPORT BEACH, CALIFORNIA,

WHETtEAS, the City Council of the City of Newport Beach,
8
ralifornia, having heretofore instructed the City Engineer in the
9
matter of the proposed improvement of certain alleys in Corona del
10
Mar, lying Northeasterly of Coast Boulevard (State Highway) between
11
Dahlia Avenue and Poppy Avenue, to procure the data and prepare a
12
written report pi_irsuant to the provisions of the "Special Assessmen
13
investigation, Limitation and Majority Protest Act of 1931 ", being
14
Part 2, Division IV of the Streets and Highways Code of the State
15
of California, and thereafter the said City Engineer presented to
16
this City Council the said written reports and
17
WHEREAS, pursuant to the provisions of said Part 2, Division
18
IV of the said Streets and Highways Code, the City Council shall,
19
by resolution or ordinance, determine in general the nature,
20
location and extent of the proposed improvement; genevally define
21
the boundaries or extent of the district or lands to be specially
22
assessed to nay the costs thereof, or any part of such costs; and
23
determine the statute under !7hich it i's proposed to conduct the
24
proceedings for such improvement and for the issuance of bonds
25
therein, if any.

NOW, THEREFORE., BE' IT RESOLVED AND D?TFRMIYFT,% by the City
27
Council of the City of Newport Beach, California, as folloe ?se

1, That the etritten report presented by the City Engineer
•

for theproposed improvement herein referred to is hereby approved,
30
and it i.s ordered that the said report be filed in the office of
31
the City Clerk for public inspection.

2. That the proposed improvement herein mentioned is

described as: -
(a) Grading, paving with plant mix material, installation of
house sewer and -rater connections, and appurtenant work in connect
thereTrith; in those certain
ALLEYS
in Corona del Mar, lying Northeasterly of Coast Boulevard (State
Highway) and between Dahlia Avenue and Poppy Avenue, except the
alleys lying Southerly of Third Avenue between Heliotrope Avenue
Iris Avenue.
The said grading and paving shall extend 8 -1/2 feet into
street at all alleys intersecting Second Avenue, Third Avenue and
Fourth Avenue, as particularly shown on the map hereinafter re

(b) The construction of reinforced concrete pipe storm drains
head *calls, catch basins, and outlets at the following locations:
in the
ALLEY
in Block 736 Corona Del Mar and extending across Fifth Avenue and a
public easement over the Southeasterly corners of Lots 2 and 4 of
said Rlock 736; and in a public
EASEMENT
over Lot 3, Block M. Tract No, 323 and extending Southwesterly into
Post Boulevard and Northeasterly into the alley in Block 634
Corona Del Mar; and in a public
EASEMENT
over the Northerly side of Lot 3, Block M. Tract No. 323 and
extending Southwesterly into Coast Boulevard and Northeasterly into
the alley in Block 733 Corona Del Mar.
3. That all of said ryork and improvement, proposed to be done
shall be constructed along the lines, between the points and at the
places shoT -m on Map 434, consisting of 3 sheets, filed T -Jith said
report and by this reference made a part hereof.

4. That the district or lands to be special- assessed to pay
the costs of said proposed improvement, is shown upon Map 434,
consisting of 3 sheets, filed with and forming a part of said
written report. Reference is hereby made to said map for further,
full and more complete description of said assessment district,
and the said map so on file shall govern for all details as to the
extent of said assessment district.
5. That the proposed improvment shall be done under the
provisions of the "Improvement Act of 1911 ", being Division VII of
the Streets and Highways Code of the State of California.
6. That serial bonds, bearing interest at the rate of six pe
cent (6 %) per annum, and extending over a period ending nine (9)
years from the second date of January next succeeding the next
October fifteenth following their date, shall be issued hereunder in
the manner provided by the said "Improvement Act of 1911 ", being
Part 5, Division VII of said Streets and Highways Code, to represent
each assessment of Twenty -five Dollars (S25.00) or more, remaining
unpaid for thirty (30) days after the date of recording the
assessment warrant.
7. That the said City Council hereby fixed Monday, the 9th
day of April, 1951, at the hour of seven - thirty o'clock (7:30) P.M.
as the date and hour, and the council chambers of the City Council
in the City Hall of said city as the place of hearing on the
written report of the City Engineer, and hereby orders such hearing
to be held by the City Council of said city.
