AND BE4+EEN DAHLIA AVENUE AND POPPY AVENUE
IN SAID CITY; DECLARING THE IUM TO BE
OF MORE THAN LOCAL OR ORDINARY PUBLIC
BENEFIT AND DESCRIBING THE DISTRICT TO BE
BENEFITED BY SAID TfCRK AND TO PAY THE COSTS
AND EXPENSES AND FIXING A TINE AND PLACE
FOR HEARING OBJECTIONS TO SAID WORK.
The City Council of the City of Newport Beach, pursuant to
the provisions of the "Improvement Act of 1911 ", being Division VII
of the Streets and Highways Code of the State of California, DOES
RESOLVE as followss
SECTION 1". That the public interest and convenience
require, and it is the intention of the City Council of the City of
Newport Beach, California, to order the following work to be done, to -wits
DESCRIPTION OF WORK
Firsts The grading, paving with plant mix material,
construction and installation of house sewer and water connections,
and appurtenant work in connection therewith; in the first
ALLEY
lying Northwesterly of Fernleaf Avenue, between the Southwesterly line
of Fifth Avenue and the Northwesterly prolongation of the Southwesterly
line of the first alley lying Southwesterly from and parallel with
Fifth Avenue, as shown on Sheet 3 of the plans hereinafter referred to;
and in the first
ALLEY
hying Northwesterly of Heliotrope Avenue and extensions of said alley,
between the Southwesterly line of Fifth Avenue and the Northeasterly
curb line of Fourth Avenue; and between the Southwesterly curb line of

• line of the first alley lying Southwesterly from and parallel with
Fourth Avenue, as shown on Sheet 3 of said plans; and in the first

being the Southerly 3 feet of Lot 2, Block M. Tract No. 323, as
per map recorded in Miscellaneous Map Book 14, Pages 40 and 41,
Records of Orange County, California, and extending Southwesterly
to the Northeasterly curb line of Coast Boulevard and Northeasterly
into the alley lying adjacent to said Lot 2, as shown on Sheet 2
of said plans= and in that certain public
being the Southerly 3 feet of the Northerly 31.50 feet of Lot 3,
Block N, said Tract No. 323, and extending Southwesterly to the
Northeasterly curb line of Coast Boulevard, and Northeasterly into
the alley lying adjacent to said Lot 3, as shown on Sheet 2 of
said plans.
PLANS, PROFILES, DRAVINGS
AND SPECIFICATIONS
SECTION 2. All of the said work and improvement to be done
shall be constructed upon the grades, along the lines, between the
ports, of the dimensions, at the places and in the manner shown on
the plans, profiles and drawings for the construction of said improve-
meats in certain alleys Northeasterly of Coast Boulevard, between
Dahlia Avenue and Poppy Avenue, being Plan No. 434 consisting of 11 sheets,
on file in the office of the City Engineer of said City and, except as
otherwise provided on said plans, in further accordance with the
specifications for the construction of said improvement, said specifications
being on file in the office of the City Clerk of said City and to which
• plans, profiles,drawings and specifications heretofore approved by the
City Council of said City, reference is hereby made for a further,
full and more particular description of the said work and by reference
thereto, the same are incorporated herein and made a part hereof,

DESCRIPTION OF ASSESSMENT DISTRICT
SECTION 3. That the paid contemplated work and improvement,
in the opinion of the said City Council, is of more than local or
ordinary public benefit, and the said City Council hereby makes the
expenses of the said work and improvement chargeable upon a district,
which said district the said City Council hereby declares to be the
district benefited by said work and improvement and to be assessed
to pay the costs and expenses thereof, and which district is described
as followat
All that certain territory of the City of Newport Beach,
California, exclusive of streets and alleys, included within the
exterior boundary line shrnm upon that certain Yap or Plat No. 434,
Sheet 1, heretofore approved by the City Council of said City on the
13th day of August, 1951, indicating by said boundary line the extent
of the territory included within the proposed assessment district,
and which map or plat is on file in the office of the City Engineer
of said City. Reference is hereby made to said map or plat for a
further, full and more particular description of the said assessment
district, and the said map or plat so on file shall govern for all
details as to the extent of the said assessment district.
DESCRIPTION OF BONDS
SECTION 4. That serial bonds, bearing interest at the rate
of six per cent (6%) per anmm, shall be.issued to represent each
assessment of Twenty -five Dollars 025.00) or more remaining unpaid
for thirty (30) days after the date of recording the warrant. Said
serial bonds shall extend over a period ending nine (9) years from
the second day of January next succeeding the next October fifteenth
following their date. Payments on the principal of unpaid assessments
and interest thereon shall be made by property owners to the City
Treasurer, and the same shall be disbursed by said City Treasurer,
all as provided in the "Improvement Act of 1911" hereinafter referred to.

SECTION 5. NOTICE IS HEREBY GIVEN that on the day
• of , 1951, at the hour of seven - thirty (700) o'clockp
P.M., in the chambers of the City Council in the City Hall of said
City of Newport Beach, any and all persons having any objections to
the proposed work or improvement or to the extent of the assessment
district, or to the proposed grades, may appear and show cause why
said work should not be done or carried out in accordance with this
Resolution of Intention. Protests must be in writing and must be
delivered to the City Clerk prior to the time set for the hearing.

SECTION 6. That all of the work herein proposed shall be
done and carried through in pursuance of an act of the legislature
of the State of California, designated the ulmprovument Act of 19110,
being Division VII of the Streets and Highways Code of the State
of California.

SECTION 7. The "Newport- 2F�'Or Fh". a "
� a weekly newspaper,
printed, published and of general circulation in the City of
Newport Beach, California, is hereby designated as the newspaper in
which this Resolution of Intention shall be published by the City
Clerk, in the manner and form provided by law and for making all
other publications in the proceedings under this Resolution of Intention.
The City Clerk is directed to mail notices of the adoption
of this Resolution of Intention to all persons owning real property
proposed to be assessed, whose names and addresses appear on the
last equalized assessment roll for city tares, all in the manner and
• form provided for under Sections 5070, 5194 and 5195 of the said
nlmprovement ,,ct of 191141 of said Strects and Highways Code.
POSTING OF NOTICE OF IN ROVE MRT
SECTION 8. The Superintendent of Streets of the City
Of Newport Beach shall cause to be conspicuously posted along the
line of said contemplated work or improvement and along all open
streets within the district liable to be assessed for said work,
notices of the passage of this Resolution of Intention, in the
time, form and manner provided by said Code.
INVESTIOATTON REPORT
SECTION 9. That the written report of the City Engineer
of the City of Newport Beach, filed February 26, 1951, on the proposed
improvement herein described and prepared pursuant to the provisions
of the "Special Assessment Investigation, Limitation and Majority
Protest Act of 1931 ", being Division IV of the Streets and Highways
Code as modified by a resolution of the City Council of said City
on the 23rd day of April, 1951, is on file in the office of the
City Clerk and open to public inspection.
