RESOLUTION OF INTENTION NO. 3966
RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, DECLARING ITS
INTENTION TO ORDER CONSTRUCTION OF SANITARY
SEWERS. AND APPURTENANCES TO SERVE THE AREA
SOUTHWESTERLY OF OCEAN BOULEVARD (CORONA DEL
MAR) IN SAID CITY; DECLARING THE WORK TO BE
OF MORE THAN LOCAL OR ORDINARY PUBLIC
BENEFIT AND DESCRIBING THE DISTRICT TO BE
BENEFITED BY SAID WORK AND TO PAY A
PORTION OF THE COSTS AND EXPENSES, AND
FIXING A TIME AND PLACE FOR HEARING
OBJECTIONS TO SAID WORK.
The City Council of the City of Newport Beach, pursuant to
the provisions of the "Improvement Act of 1911 ", being Division
7 of the Streets and Highways Code of the State of Calibrnia, does)
resolve as follows:
SECTION 1. That the public interest and convenience require,
and it is the intention of the City Council of the City of Newport)
Beach, California, to order the following work to be done, to -wit:
DESCRIPTION OF WORK
=: The construction of vitrified clay pipe.sanitary
sewers, vitrified clay pipe house connection sewers, Wye branches,)
manholes and appurtenant work in connection therewith, in that
certain public

owned by the City of Newport Beach and described as Lot "A" of
Tract 1026, as per map recorded in Miscellaneous Maps Book 33,
Pages 37 and 38, and Lot "A" of Tract 1257, as per map recorded
in Miscellaneous Maps Book 38, Page 25, Records of Orange County,
California, between a line drawn parallel with and distant 5 feet
Northwesterly from the produced Northwesterly line of Lot 1 of
said Tract 1026, and the Southeasterly end of Lot "A':' of said
Tract 1257, and extending Southeasterly into a public easement to
manhole No. 6, all as shown on'_.Sheets 2 and 3 of the plans here-
inafter referred to.
Second: The construction of vitrified clay pipe sanitary

sewer, Wye branches, lamphole and appurtenant work in connection
therewith, in that certain public
EASEMENT
over and along the Southeasterly 5 feet of Lots 26, 28 and 30,
Block A -36, Corona Del Mar, as per map recorded in Miscellaneous
Maps Book 3, Pages 41 and 42, Records of said County, connecting
with manhole No. 3, as shown on Sheet 2 of said plans.
Third: The construction of vitrified clay pipe sanitary
sewer, Wye branches, lamphole, manhole and appurtenant work in
connection therewith, in that certain public
EASEMENT
in the vacated alley of Block A -35 of said Corona Del Mar, and
extending Southwesterly into a public right of way to a manhole
to be constructed hereunder, as shown on Sheet 4 of said plans.
Fourth: The construction of welded steel sewer main, Wye
branches, manholes, concrete anchor blocks and appurtenant work
in connection therewith, in that certain public
EASEMENT
from manhole No. 6, located in public easement between Lots 8 and
9 of said Tract 1257, and thence Southeasterly over and across
Lots 9 to 15, inclusive, of said Tract 1257, and extending South-
easterly into a portion of Block "A" of said Corona Del Mar, as
shown on Sheet 3 of said plans.
Fifth: The construction in that certain public easement,
known as Lot "A" of said Tract 1026, at a point opposite the line
between Lots 16 and 17 of said Tract, of a reinforced cement
concrete sump and pump chambers, together with the installation
of pumps, motors, electrical applicarices, conduits, floats, cast
iron pipes, valves, fittings, equipment and appurtenances for the
umping or lifting of raw sewage, as shown on Sheets 2, 3, 4 and 5
of said plans.
Sixth: The construction in connection with said pump statio
of a welded steel sewer pressure line and concrete anchor blocks,

running from said pump station over and along an easement, being
the Southeasterly 4 feet of Lot 16 of said Tract 1026, crossing
Ocean Boulevard, and in Marguerite Avenue connecting with an
existing manhole located at the intersection of the center line
of said Marguerite Avenue with the Southeasterly prolongation of
the center line of the first alley lying Northeasterly from Ocean
Boulevard, as shown on Sheet 4 of said plans.
PLANS, PROFILES, DRAWINGS
AND SPECIFICATIONS
SECTION 2. That all of the said work and improvement to be
done, shall be constructed upon the grades, along the lines, be-
tween the points, of the dimensions, at the places and in the
manner shown on the plans, profiles and drawings for the
construction of said improvements, being Plan No. 436 consisting
of 5 sheets, on file in the office of the City Engineer of said
City, and except as otherwise provided on said plans, in further
accordance with the specifications for the construction of said
improvements, said specifications being on file in the office of
the City Clerk of said City, and to which plans, profiles, drawin,
and specifications heretofore approved by the City Council of
said City, reference is hereby made for a further, full and more
particular description of said work and by reference thereto, the
same are incorporated herein and made a part hereof.
DESCRIPTION OF ASSESSMENT DISTRICT
SECTION 3. That the said contemplated work and improvement,
in the opinion of said City Council, is of more than local or
ordinary public benefit and the said City Council hereby makes a
portion of the expenses of said work and improvement chargeable
upon a district, which district the said City Council hereby
declares to be the district benefited by said work and improve-
ment and to be assessed to pay the costs and expenses thereof,
and which district is described as follows:

All that certain territory in the City of Newport Beach,
California, exclusive of streets and alleys, included within the
exterior boundary line shown upon that certain map or plan, No.
436 -A, heretofore approved by the City Council of said City on
the 28th day of April, 1952, indicating by said boundary line the
extent of the territory included within the proposed assessment
district, and which map or plat is on file in the office of the
City Engineer of said City. Reference is hereby made to said map
or plat for a further, full and more particular description of
said assessment district, and the said map or plat so on file
shall govern for all details as to the extent of said assessment
district.
DESCRIPTION OF BONDS
SECTION 4. That serial bonds, bearing interest at the rate
of six per cent (6 %) per annum, shall be issued to represent each
assessment of Twenty -five Dollars ($25.00) or more, remaining
unpaid for thirty (30) days after the date of recording the
warrant. Said serial bonds shall extend over a period ending nine,
(9) years from the second day of January next succeeding the next
October fifteenth following their date. Payments on the principal
of unpaid assessments and interest thereon shall be made by
property owners to the City Treasurer, and the same shall be dis-
bursed by said City Treasurer, all as provided in the "Improvement
Act of 1911 ", hereinafter referred to.
PORTION OF COSTS AND EXPENSES
TO BE PAID OR MATERIAL FURNISHED BY CITY
SECTION 5. NOTICE IS HEREBY GIVEN, that the City Council of
the City of Newport Beach had determined and does hereby declare
that said City will furnish two (2) sewage pumps, together with
electric motors to be installed by the contractor in the pump
station described in Section 1 hereof, and will in addition there-
to contribute but of its Corona Del Mar State Park Fund the sum
of $5,636.75 towaxi the costs and expenses of said improvement.

The liability and obligation to pay such sum, as provided herein,
shall accrue and become fixed upon the date of the confirmation
of the assessment by the City Council of said City.
TIME AND PLACE OF HEARING
SECTION b. NOTICE IS HEREBY GIVEN, that on the 9th day of
June, 1952, at the hour of seven - thirty o'clock (7:30)P.M. in
the chambers of the City Council in the City Hall of said City
of Newport Beach, any and all persons having any objections to
the proposed work or improvement, or to the extent of the assess-
ment district, or to the proposed grades, may appear and show
cause why said work should not be done or carried out in accord-
ance with this Resolution of Intention. Protests must be in
writing and must be delivered to the City Clerk prior to the time
set for the hearing.
IMPROVEMENT ACT
SECTION 7. That all of the work herein proposed shall be
done and carried through in pursuance of an act of the legislat
of the State of California, designated the "Improvement Act of
1911 ", being Division 7 of the Streets and Highways Code of the
State of California.
PUBLICATION OF RESOLUTION OF INTENTION
SECTION 8. The Newport Harbor Ensign, a weekly newspaper
printed, published and of general circulation in the City of
Newport Beach, California, is hereby designated as the newspaper
in which this Resolution of Intention shall be published by the
City Cle$c, in the manner and form provided by law, and for maki
all other publications in the proceedings under this Resolution
of Intention.
The City Clerk is directed to mail notices of the adoption
this Resolution of Intention to all persons owning real property
proposed to be assessed, whose names and addresses appear on the
last equalized assessment roll for city taxes, all in the manner

and form provided for under Sections 5070, 5194 and 5195 of
said "Improvement Act of 1911" of said Streets and Highways
Code.
POSTING OF NOTICE OF IMPROVEMENT
SECTION 9. That the Superintendent of Streets of the City
of Newport Beach shall cause to be conspicuously posted along
the line of said contemplated work or improvement, and along all
open streets within the district liable to be assessed for
said work, notices of the passage of this Resolution of Intention,
in the time, form and manner provided by said Code.
PASSED AND ADOPTED by the City Council of the City of
Newport Beach, California, at a regular meeting thereof, held
this 28th day of April, 1952, by the following vote, to -wit:
AYES: Councilmen Miller, Horvath, Finch, Isbell, Smith
NOES: Councilmen None
ABSENT: Councilmen None
