RESOLUTION OF THE CITY COUNCIL OF THE
• 2 CITY OF NEWPORT BEACH, CALIFORNIA,
ORDERING THE WORK DESCRIBED IN
3 RESOLUTION OF INTENTION NO. 3966

The City Council of the City of Newport Beach, California,

pursuant to the provisions of the "Improvement Act of 1911 ", being
7
Division Vii of the Streets and Highways Code of the State of Cali -
8
fornia, DOES RESOLVE as follows:

That the public interest and convenience require the work
10
hereinafter mentioned to be done and, therefore, the said City
11
Council hereby orders the following work to be done and improve-
12
ments to be made in said City, to -wit:

The construction of vitrified clay pipe sanitary sewers,
14
vitrified clay pipe house connection sewers, welded steel sewer
15
pipe, vitrified clay pipe lamp -hole, manholes, sewage pumping
16
station, welded steel sewer pressure line, concrete anchor blocks,
17
and appurtenant work in connection therewith, in certain easements
18
of the City of Newport Beach and lying generally Southwesterly of
19
Ocean Boulevard (Corona Del Mar), all as more particularly
20
described in Resolution of Intention No. 3966 passed and adopted
21
by the City Council of said City on the 28th day of April, 1952,
22
and on file in the office of the City Clerk of said City.

For further particulars, reference is hereby made to said
24
Resolution of Intention No. 3966 and to the plans, profiles and
25
drawings No. 436, consisting of 5 sheets, on file in the office of
26
the City Engineer of said City of Newport Beach, and to the
27
specifications for the said work heretofore adopted by the said

City Council and on file in the office of the City Clerk of said
• 29
City, and all of said plans, profiles, drawings and specifications
30
heretofore approved by the City Council of said City are incor-
31
porated herein and made a part hereof, and reference is hereby
32
made thereto for a more particular description of said work.

Said City Council has determine and declared that the con-
templated work and improvement heretofore mentioned was, in the
opinion of said City Council, of more than local or ordinary public
benefit and the said City Council has made a portion of the ex-
penses of said work chargeable upon a district. For the particular
description of said district, reference is hereby made to said
Resolution of Intention No. 3966.
Said City Council has determined and declared that serial
bonds, bearing interest at the rate of six per cent (6 %) per annum
and extending over a period ending nine (9) years from the second
day of January next succeeding the next October 15th following
their date, will be issued hereunder in the manner provided by
the "Improvement Act of 1911 ", being Part 5, Division VII of the
Streets and Highways Code of the State of California, to represent
each assessment of Twenty -five Dollars ($25.00) or more remaining
unpaid for thirty (30) days after the date of recording the
warrant.
Said City Council has also determined and declared in said
Resolution of Intention No. 3966 that the said City will furnish
two (2) sewage pumps, together with electric motors to be in-
stalled by the contractor in the pumping station described in
said Resolution of Intention, and will in addition thereto con-
tribute out of its Corona Del Mar State Park Fund the sum of
$5,636.75 towards the costs and expenses of said improvement. The
liability and obligation to pay such sum, as provided in said
Resolution of Intention, shall accrue and become fixed upon the
date of confirmation of the assessment by the City Council of
said City.
All of the work herein ordered shall be done and carried
through in pursuance of an act of the legislature of the State of
California, designated the "Improvement Act of 1911 ", Division
VII of the Streets and Highways Code.

The Clerk of said City is hereby directed -:'to post
conspicuously for five (5) days on or near the chamber door of the
City Council, in the manner and form required by said Code, a
Notice Inviting Sealed Proposals or Bids for doing the work herein
ordered, and the City Clerk is hereby directed to publish twice in
the "Newport Harbor Ensign ", a weekly newspaper published and
circulated in said City and hereby designated by the said City
Council for that purpose, a notice inviting such proposals or bids
for doing the said work and referring to the specifications on file
PASSED A14D ADOPTED by the City Council of the City of Newport
Beach, California, at a regular meeting thereof held on the 28th
day of July, 1952, by the following vote, to -wit:
