RESOLUTION NO. 4040
WHEREAS, there was submitted to the City Council of the
City of Newport Beach an agreement dated, January 26th, 1953, by
and between the said City of Newport Beach, a municipal corporati
of the 6th class, and the Sully- Miller Contracting Company, a
corporation, wherein and whereby the City of Newport Beach did
grant to the Sully- Miller Contracting Company the right to extra
base material from a portion of the city dump site, more particu
described in the above mentioned agreement; and
WHEREAS, by mutual agreement, certain terms of the
original contract were modified and amended and the same, as
amended and modified, has been submitted for the approval of the
City Council; and
WHEREAS, it appears to be for the best interest of the
citizens of the City of Newport Beach to enter into said amended
and modified agreement;
NOW, THEREFORE, BE IT RESOLVED, thatResolution No. 4031
authorizing the execution of the contract, be and the same is,
hereby rescinded and be it further resolved that the City of New
port Beach enter into said amended and modified agreement with
said Sully- Miller Contracting Company, and the Mayor and City
Clerk of the City of Newport Beach are hereby authorized and
directed to execute said agreement for and in behalf of the City
of Newport Beach, and the City Clerk is authorized and directed
to transmit an executed copy of thereof to said Sully- Miller Con
tracting Company.
The above and foregoing resolution was duly and regularly
passed and adopted at a regular meeting of the City Council of
the City of Newport Beach, held on the 24th day of February,
1953, by the following roll call vote, towit:
AYES, COUNCILMEN: Smith, Finch, Isbell, Bennett, Mill
NOES, COUNCILMEN: None
ABSENT COUNCILMEN: None
