RESOLUTION NO. 4063
WHEREAS, by Resolution No. 4055, the City Council of the
City of Newport Beach declared its intention to call a special
election to be held on the thirteenth day of May, 1953, in cer
inhabited territory contiguous to said city proposed to be
annexed to said city, for the purpose of submitting to the
qualified electors residing in said territory the question whe
or not said territory shall be annexed to said city; and
WHEREAS, a copy of said resdution was published as required
by law; and
WHEREAS, at a time not later than the hour set by said
resolution for hearing objections to the proposed election no
written or oral protests were made by the owners of a majority of
separate parcels of property within the territory proposed to be
annexed; and
WHEREAS, all proceedingshave been had in accordance with
said resolution and the Annexztion Act of 1913, reference thereto
being made for further particulars;
NOW, THEREFORE, BE IT RESOLVED as follows:
SECTION 1. A special election hereby is called to be held
on the thirteenth day of May, 1953, in the territory hereinafter
described and proposed to be annexed to the City of Newport
Beach, for the purpose of submitting to the qualified electors
residing in said territory the question whether or not such
territory shall be annexed to, incorporated in, and made a part
of said City of Newport Beach, and whether or not the property
in said territory shall, after such annexation, be subject to
taxation, equally with the property within the City of Newport
Beach, to pay the entire bonded indebtedness of the City of
Newport Beach outstanding or authorized at the date of the filin;
of the petition for annexation for the acquisition, construction
or completion of municipal improvements.

Said territory is described as follows:
All that certain land situated in the Costa Mesa
Sanitary District, Newport Heights Irrigation District,
County of Orange, State of California, described as
follows:
Beginning at the intersection of the Southwesterly
prolongation of the Southeasterly line of Irvine Avenue,
60 feet wide, and the Southeasterly prolongation of the
center line of Fifteenth Street, as shown upon a map of
Newport Heights, recorded in Book 4, page 83, of Miscell-
aneous Maps, records of Orange County, California;
thence Northeasterly along the said Southwesterly pro-
longation of the Southeasterly line of said Irvine Ave-
nue and along said Southeasterly line of said Irvine
Avenue and its Northeasterly prolongation to its inter-
section with the Southeasterly prolongation of the
Northeasterly line of Sixteenth Street as shown upon
said map of Newport Heights; thence Northwesterly along
said prolongation of said Northeasterly line of Sixteenth
Street and along the Northeasterly line of Sixteenth
Street to its intersection with a line lying 30 feet
Northwesterly of and parallel to the center line of
Santa Ana Avenue as shown upon said map of Newport
Heights; thence Southwesterly along said parallelline
to its intersection with the center line of Fifteenth
Street; thence Southeasterly along said center line of
Fifteenth Street to the point of beginning.
Excepting therefrom the following, to -wit: Beginning
at the most Southerly corner of Tract 1583; thence
Northeasterly along the Southeasterly line of said Tract
to the most easterly corner of said Tract; thence North-
westerly along the Northeasterly line of said Tract 1583
to the most Northerly corner; thence Southwesterly along
the Northwesterly line of said Tract and its South-
westerly prolongation to its intersection with the center
line of Fifteenth Street as shown upon said Map of Newport
Heights; thence Southeasterly along said center line to
its intersection with the Southwesterly prolongation of
the Southeasterly line of said Tract; thence Northeasterly
along said Southwesterly prolongation to the point of
beginning.
Said territory is designated and identified for said
election pur�oses and for use upon the ballots at said
election as 'Seaquist Annexation ".
SECTION 2. TIME OF OPENING AND CLOSING OF POLLS. The
polls at said election shall be opened at 7 o'clock a.m. of the
day herein fixed for the holding of said election and shall be
kept open until 7 o'clock p.m. of the same day, when the polls
shall be closed.
SECTION 3. BALLOTS. Upon the ballots to be used at said
election there shall be printed the words:
1 SHALL SEAQUIST ANNEXATION BE ANNEXED TO, INCORPORATED
IN AND MADE A PART OF THE CITY OF NEWPORT BEACH AND THE
2 PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION,
• SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE
3 CITY.OF NEWPORT BEACH, TO PAY THE ENTIRE BONDED INDEBTED-
NESS OF THE CITY OF NEWPORT BEACH OUTSTANDING OR AUTHORIZED
4 AT THE DATE OF THE FILING OF THE PETITION FOR ANNEXATION
FOR THE ACQUISITION CONSTRUCTION OR COMPLETION OF MUN-
5 ICIPAL IMPROVEMENTS3

Opposite these words there shall be printed the words "Yes"
7
and "No ", and to the right of each of these last two words there
8
shall be a voting square. If an elector shall stamp a cross (i)
9
in the voting square after the printed word "Yes" the vote of
10
such elector shall be counted in favor of the annexation of s6aid
11
territory to the City of Newport Beach; and if an elector shall
12
stamp a cross (4) in the voting square after the printed word
13
"No" the vote of such elector shall be counted against such
14
annexation.

In all particulars not herein recited said election shall be
16
held in conformity, as near as may be, with the laws of the State
17
of California concerning general elections and with said Annexatic
18
Act of 1913.

SECTION 4. (a) For the purpose of said election there
20
hereby is established in the territory described herein one (1)
21
voting precinct, which shall include all of said territory. The
22
following is the polling place of said election precinct and the
23
following named persons hereby are named officers of election and

shall constitute the board of election for such election precinct:

(b) For their services in connection with said election,
said inspector shall receive $10.00 and said judges $10.00 each;

and the person in possession of the polling place named herein

shall receive for the use of such premises in connection with saic
election the sum of $10.00.

SECTION 5. The City Clerk shall publish a notice of said
special election as required by said Annexation Act of 1913, at
least once a week for the four (4) weeks prior to the date of the
election on May 13, 1953, in the Costa Mesa Globe- Herald, a news-
paper of general circulation printed and published outside of the
City of Newport Beach but in the County of Orange, California.
I hereby certify that the foregoing Resolution No. 4063
was adopted by the City Council of the City of Newport Beach at
its meeting held on the 13th dayof April, 1953, by the following
vote:
