A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH CALIFORNIA, DECLARING ITS
INTENTION'TD ORDIR THE .INSTALLATION OF SANI-
TARY SEWERS 111 CLIFF DRIVE AND OTHER STREETS
AND RIGHTS OF WAfp AND DECLARING THE WORK OR
IMPROVEMENT TO BE OF MORE THAN ORDINARY PUB-
LIC BENEFITS DESCRIB.INt; -THE DISTRICT TO BE
BENEFITED.T14ERKBI AND TO BE ASSESSED TO PAY

WHIIREAS, the City Council of the City of Newport Beacb,
California, has on file and spread on the minutes of the City
Council a report from the Health Officer for said City of
Newport beach, recommending the institution of proceedings
for the said improvement as a health measure; and
WHIREAB, the City Council has found and determined by
Resolution that the public interesty convenience and necessity
require the installation of sanitary sewers in Cliff Drive and
other streets and rights of way, and that the improvement is
necessary as a health Measure,
ADW, TRZREFORE, the City Council of the City of Newport
Beach, California, DOES HBREBY RESOLVE as follows;
SECTION 1. That the public interest and convenience
require, and it is the intention of the City Council to order
the'following work to be done, to wit.

SECTION 2. That all of the work aforesaid shall be done .
in accordance with and to the grades shown on Plan lo. 441, con- T:;
listing of 17 sheets, on file in the Office of the City Engineer.
and except as otherwise provided on said Plan, in further accord-
ance with the Specifications for said work, entitled "Specifica.-
tions for the Construction of Sanitary Sewers in Cliff Drive and
Certain Other Streets, Alleys, and Basements ", on file in the
Office of the said City Engineer, and in the Office of the City
Clerk. 1
Said Plan and Specifications are hereby referred to for a
full and detailed description of said proposed work or improvement
and for the proposed grades thereof.
SECTION 3. That the said contemplated work or Improvement,
in the opinion of said City Council, is of more than local or s t>
ordinary public benefit, and said City Council hereby makes the
costs and expenses of said work or improvement chargeable upon a
district, which district said City Council hereby declares to be
the district to be assessed to.pay the costs and expenses thereof..-
Said district is described by a asp indicating by a boundary line`'
the extent of the territory included in the proposed district,
numbered 441-A, consisting of 6 sheets, which is on file in the
Office of the City Engineer and in the Office of the City Clerk„
The said asp so on file shall govern for all details as to the
extent of said assessment district. All public streets or alleys
or portions thereof are hereby excepted from said district.
SECTION 4. That serial bonds bearing interest at the rate
of six per cent (6x) per annua shall be issued to represent each ,
assessment of Twenty-five Dollars ( ;28.00), or more, remaining
unpaid for thirty (30) days from the date of the recordation of
the Warrant. Said serial bonds shall extend over a period ending'`.

SECTION 5. That notice is hereby given that Monday, the
22nd day of Aumum , 1955, at the hour Of 7830.otclock
P,M.; Pacific Daylight Saving Time, is the day and hour, and the
Council Chambers in the City Hall in the City of Newport Beach,
is the place fixed by said City Council when and where any and
all persons having any protests or objections to the proposed
work or .improvement, or to the extent of the district, or both,
or to the proposed grade, may appear before the Council and show
cause why said proposed improvement should not be carried out in
accordance with this Resolution.
SECTION 8. That the proceedings for the aforesaid improve-;.
Tent shall be had and taken under and in accordance with the
"Taprovement Act of 1911 ", being Division 7 of the Streets and
H.i.ghways Code of the State of California.
SECTION 7, The proceedings for this improvement have been,,,
instituted upon the recommendation of the Health Officer for the
City of Newport Beach. That from a public health standpoint it
Js advisable and urgent that sanitary sewers and appurtenances be
constructed within the above designated area immediately and that
the institution of improvement proceedings is necessary as a health
measure. That said recommendation was made pursuant to Section 2808
of the said Streets and Highways Code.. The estimated cost of the

SECTION 8. That notices of the adoption of this ReQt;lutirn.
shall be mailed, postage prepaid, by the City Clerk' to all persona
owning real property proposed to be assessed to pay any part of
the cost of the work, whose naves and addressee appear on the
last equalized assessment roll, or as known to the Clerk. If
property assessed by the State under Section 14 of Article X11.1
of the Constitution As proposed to be assessed, such notice stall
be mailed to every owner of such property at the address thereof
shown on the last Board roll transmitted to the County Auditor
and that the Superintendent of Strwets shall cause to be con
spciuously posted along the line of said contemplated work or
improvement and on all open streets within the district liable
to be assessed, notices of the passage of this Resolution, all
In the manner and in the form required by law.
SECTION 9, The City Clerk shall certify to the passage off-1,
this Resolution and shall cause the same to be published twice
by two consecutive and separate .insertions in the "NEWPORT
HARBOR NEWS PRESS" , a newspaper published and circulated -','`

in said City. The first publication shall be made not less than
ten (10) days prior to the date of the public hearing stated
herein.
