RESOLUTION NO. H N2 7
WHEMS, there has this day been presented to the City
Council of the City of Newport Beach a certain Agreement between
the Newport Beach City Library and the Newport Beach School
District setting forth their mutual promises with regard to the
establishment of a branch library at the Horace Ensign Schods and
WHEREAS, it appears to be for the best interests of the
citizens of the City of Newport Beach that said agreement be
entered into]
NOW, TBEREVORE, be it resolved that the members of the
Board of Trustees Of the Newport Beach Public Library be and they
are hereby authorized and directed to execute said agreement on
behalf of the City; and
BE IT FURTHER RBSOLVRD, that the for and the City
Clerk be and they are hereby authorized and directed to approve
said agreement.

The above and foregoing Resolution was duly and
regularly passed and adopted by the City Council of the City of
Newport Beach at a regular meeting thereof held on the ; M day
of December, 1955, by the following vote, to wits

THIS AOREEMENT made and entered into this e� % o day
of ZZ' r�ti , 195 SS , by and between NEWPORT
BEACH CITY LIBRARY, hereinafter referred to as "Library ", and
NEWPORT BEACH SCHOOL DISTRICT of orange County, California,
hereinafter referred to as "School ";
W I T N E S 3 3 T H:
Pursuant to the provisions of Sections 24441 through
24412 of the Education Code, the parties hereto in consideration
of their mutual promises, agree as follows:
I
School hereby grants Library permission to use the
School Library located in the Horace Ensign School Building dur-
ing the afternoons, evening hours and weekends during such time
as the use of said building by Library does not conflict with
the use by School for school purposes of said Library. Problems

which may arise in the coordination of School and Library programs
shall be referred to the District Superintendent of Schools and
may also be referred to the respective Boards of Trustees.
II
School and Library mutually agree to exercise diligence
in the care of the equipment and supplies but, neither School nor
Library shall assume liability for loss or damage to the property
of the other.
III
School agrees to provides
A. A librarian to be in charge when library is being
fused by School.
B. The building, utilities, maintenance and custodial
(care of the books and furniture placed in said building by
Library.

C. A set of bookshelves in the section reserved for
public use.
D. Cards for public library books which are to be used
in the carrying out of this program.
S. A truck and two (2) men for moving facilities
of Library to School at the commencement of the program.
Iv
Library agrees to provide:.
A. A librarian to be in charge when library is being
used by Library.
B. Hooks, reference materials and magasines with a
combined value roughly comparable to the material supplied by
School, said materials supplied by Library to be exclusive of
the adult section of the library.
C. Typing for public library cards.
D. To submit to School librarian a list of all
materials to be placed in the School library for examination and
approval before placing said books or material in said library.
F
It is mutually agreed to by the parties hereto that
(Library will furnish material and books to be used in the adult
(section, which said books and materials are to be for the
I exclusive use of adults only.
VI
School library may charge out books that are a part of
the public library collection. School books, however, shall not be
charged out by Library. Pines collected for public library books
charged Out during public library hours shall be kept by the City
of Newport Beach. Payment`' ? oV,,+aost public library books
shall be paid to the City of Newport Beach.

This Agreement may be cancelled by either party upon gi
32 notice to the other party ninety (90) days prior to the date of

termination. Upon the expiration of said ninety (90) days after
the giving of such notice, this Agreement shall be terminated
and be of no further force or value, and all city books, materials
and other property shall be returned to the main library.
