2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPOINTING AND EMPLOYING
3 WILLIAM MacKENZIE BROWN, ATTORNEY,AT LAW, TO
EKIMINE PLANS AND SPECIFICATIONS AND TO PREPARE
4 RESOLUTIONS AND ALL OTHER NECESSARY DOCUMENTS
IN THE ASSESSMENT DISTRICT PROCEEDINGS FOR THE
5 IMPROVEMENT OF NEPTUNE AVENUE AND CERTAIN OTHER
STREETS

7 WHEREAS, assessment district proceedings pursuant to the
8 Streets and Highways Code of the State of California are being
9 undertaken for the improvement of Neptune Avenue and certain other
10 streets; and
11 WHEREAS, said proceedings are of a special and highly
12 technical nature requiring the services of an attorney who special
13 izes in such street proceedings and is qualified to give an opinio
14 as to the validity of said proceedings when finally consummated;
15 and
16 WHEREAS, it is reasonably necessary to employ William
17 MacKenzie Brown for this purpose in order to expedite the proceed -
18 ings;
19 NOW, THEREFORE, BE IT RESOLVED by the City Council of th
20 City of Newport Beach:
21 SECTION 1. William MacKenzie Brown, Attorney at Law,
22 650 South Spring Street, Los Angeles, California, be and is hereby
23 appointed and employed to examine plans and specifications and to
24 prepare all resolutions, papers and other documents necessary in
25 I the assessment district proceedings for the improvement of Neptune
26 Avenue and certain other streets as above stated, except the
27 preparation of the assessment and bonds.
28 SECTION 2. The compensation for said services shall be
29 the sum of two per cent (2%) of the final construction cost.

31 This resolution was adopted by the City Council of the
32 City of Newport Beach at a regular meeting on the 9 �474 day of

Beach, California, do hereby certify that according to the records
of the City of Newport Beach filed and maintained in my office,
the foregoing Resolution No. 4938 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 9th day of March 9 19 59 by the following
vote, to wit:
