1 RESOLUTION N0. 4940
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ACCEPTING A GRANT DEED AND
3 CONSENTING TO ITS BEING RECORDED

5 WHEREAS, by an agreement dated April 81 1957, Ross Owen
6 agreed to convey to the City of Newport Beach the northwesterly 50
7 feet of Lots 9 and 10 in Block 137 of River Section; and
811 WHEREAS, Ross Owen executed and delivered a deed to the
9 City reciting such conveyance; and
10 WHEREAS, the description "the northwesterly 50 feet of
11 Lots 9 and 10" is uncertain as a result of an earlier conveyance;
12 and
13 WHEREAS, the City adopted Resolution No. 4925 accepting
14 said deed; and
15 WHEREAS, Ross C. Owen has submitted a deed with a proper
16 and more accurate description in compliance with said contract
17 dated April 8, 1957;
18 NOW.. THEREFORE, BE IT RESOLVED that Resolution No. 4925
19 be rescinded.
20 BE IT FURTHER RESOLVED that said grant deed conveying
21 the northwest half of Lots 9 and 10 in Block 137 of River Section
22
in the City of Newport Beach,
County
of Orange,
State of Calif or-
23
nia, as per map thereof recorded in Book 4, page
25 of Miscellane-
24
ous Maps in the Office of the
County
Recorder of
said County, be
25
accepted and the City Council
hereby
consents to
its being recorded.
26 This resolution was adopted by the City Council of the
27 City of Newport Beach at a regular meeting on the 9th day of
28 March, 1959, by the following vote, to wit:
29 AYES, COUNCILMEN: Hart, Lorenz, Somers,
30 Kingsley, Atkinson, Higbie, Stoddard
31 - NOES COUNCILMEN: None

I, MARGERY SCHROUDER, City Clerk of the City of Newport
Beach, California, do hereby certify that according to the records
of the City of Newport Beach filed and waintained in my office,
the foregoing Resolution No. 4940 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 9th day of March , 1959, by the following
vote, to wit:
AYES, COUNCILMEN: Hart, Lorenz, Somers, Kingsley,
NOES, COUNCILMEN:
Atkinson, Higbie, Stoddard
None
