A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS INTENTION TO ANNEX
TO THE CITY CERTAIN PROPERTY KNQfN AS HARBOR
VIE11 ANNEX AND GIVING NOTICE THEREOF
UTHEREAS, there is situated outside and contiguous to the
City of Newport Beach a certain uninhabited territory within the
meaning of the Annexation of Uninhabited Territory Act of 1939,
said territory being more particularly hereinafter described; and
WMEAS, annexation to the City would make municipal ser-
vices available to the property owners and be for the best inter-
ests of the City of Newport Beach and its citizens; and
NHEREAS, the City of Newport Beach as proponent did on
or about the 22nd day of June, 1959, submit to the Secretary of the
Orange County Boundary Commission a legal description and plat of
the hereinafter described uninhabited territory for its report
pursuant to the provisions of Section 35002 of the Government Code
of the State of California; and
WHEREAS, on the 1st day of July, 1959, there was filed
with the City Clerk of the City of Newport Beach a report of said
Orange County Boundary Commission pursuant to the provisions of
Section 35002 of the Government Code of the State of California;
and
WHEREAS, the owners of all the territory to be annexed
have filed written consent to the annexation with the City Council;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Newport Beach that proceedings are hereby initiated by the
City of Newport Beach to annex the said territory hereinafter
described, which territory is contiguous to the present boundaries
of said City and which said territory now is uninhabited within the
meaning of the Annexation of Uninhabited Territory Act of 1939 and
that the reasonsfbr said annexation are that it would make
municipal services available to the property owners and be in the

1 best interests of the City of Newport Beach and its citizens that
2 said City annex said territory.
3 NOTICE IS HEREBY GIVEN that it is proposed by said City
4 of Newport Beach to annex said hereinafter described territory to
5 said City, which said territory shall in these proceedings bear the
6 name of "HARBOR VIEW ANNEK". The specific description of the
7 boundaries of the territory so proposed to be annexed is as follows;
8 Beginning at an angle point in the Northerly boundary of the
city of Newport Beach, at the most northerly intersection of
9 said boundary with the Easterly line of MacArthur Boulevard,
said beginning being an angle point in "Parcel No. 1" of
10 "The 5 Parcel Annexation" to the city of Newport Beach and
running thence North 24 0.361 00" East along said Easterly
11 line 1,055 feet; thence South 650 241 00" East 720.00
feet; thence South 50° 141 20" East 514.39 feet; thence
12 South 630 East 820 feet; thence South 15° 201 West to the
Northeasterly extension of the Northwesterly line of that
13 certain parcel of land described in a Deed recorded June 17,
1955 in Book 3106, page 115 of Official Records in the
14 office of the Recorder of Orange County; thence South
15 370 051 40" West along said extension to a line parallel
with and distant 60 feet Northeasterly, measured at right
angles, from the Northeast line of said parcel; thence
16 South 320 341 52" East along said parallel line 956.56
feet; thence South 59° 301 East 740.00 feet; thence South
17 7° West 760.00 feet; thence Southeasterly to the Northerly
terminus of that certain course in the Northwesterly line
18 of the parcel of land described in a Deed recorded in Book
4529, page 458 of said Official Records described therein
19 as North 1° 461 30" East 166.20 feet; thence Southwesterly
20 along said-Northwesterly line to the Easterly corner of
Tract No. 673 per map recorded in Book 20, pages 17 and 18
21 of Miscellaneous Maps in the office of said Recorder, said
Easterly corner being in the boundary of the city of Newport
22 Beach; thence generally Northwesterly, Northeasterly and
Northwesterly along said boundary to the point of beginning.
23 FURTHER NOTICE IS HEREBY GIVEN that on �' the
24 Ids day of August, 1959.,-at the hour of 7:30 P. M. on sa d day,
25 or as soon thereafter as the matter may be heard, in the Council
26 Chamber of the City Hall of the City of Newport Beach, 3300 Newport
27 Boulevard, Newport Beach, California, a hearing will be had, at
28 which hearing the City Council shall hear and pass upon all written
29 protests filed at any time before said hour set for said hearing by
30 any person owning real property within the territory proposed to
31 be annexed, and at any time before the hour set for said hearing
32 any owner of property within the territory proposed to be annexed

11 may file a written protest against the annexation.
The protest
211 shall set forth the name of the owner of the property affected and
3 give a description of the said property in general terms.
4 The City Clerk of the City of Newport Beach is hereby
5 authorized and directed to cause a copy of this resolution to be
6 published once a week for two weeks, said publication to be
7 complete at least twenty (20) days prior to the date set for the
8 hearing, and the publication shall be in the Newport Harbor News
9 press, a newspaper of general circulation printed and published in
10 the City of Newport Beach, and ILL,- -
11 a newspaper of general circulation printed and published in the
12 County of Orange and outside the City of Newport Beach.
13 The City Clerk is further authorized and directed to
14 mail a notice of the proposed annexation to all persons to whom
15 land proposed to be annexed is assessed in the last available
16 equalized assessment roll, at the address shown thereon or as known

to said City Clerk.
This resolution was adopted by the City Council of the
City of Newport Beach at a regular meeting on the 13th day of July,
1959., by the following vote, to wit:

the foregoing Resolution No. 5051 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
