2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH PROHIBITING PARKING ON THE
3 SOUTHEAST RAMP AT THE INTERSECTION OF NEWPORT
BOULEVARD AND PACIFIC COAST HIGHWAY AND ON A
4 PORTION OF SAID HIGHWAY

6 WHEREAS, Section 3272 of the Newport Beach Municipal
7 Code provides that the city traffic engineer shall sign or mark
8 any place where he determines it is necessary to prohibit parking
9 in order to eliminate an unusual traffic hazard, and when so signed
10 or marked no person shall park a vehicle at any such place; and
11 WHEREAS, Section 589.5 of the Vehicle Code provides that
12 local authorities may by resolution prohibit the parking of vehicle
13 on a state highway if such resolution is first submitted to and
14 approved by the Department of Public Works; and
15 WHEREAS, the District Engineer of the Division of High -
16 ways has suggested that the City Council prohibit parking along
17 both sides of the southeast ramp at the intersection of Newport
18 Boulevard and Pacific Coast Highway and along the south side of
19 Pacific Coast Highway easterly of said ramp to the driveway
20 approximately 65 feet east of power pole No. 824187E; and
21 WHEREAS, the city traffic engineer has recommended this
22 prohibition in order to eliminate an unusual traffic hazard;
23 NOW, THEREFORE, BE IT RESOLVED that parking be prohibited
24 on both sides of the southeast ramp at the intersection of Newport
25 Boulevard and Pacific Coast Highway and along the south side of
26 Pacific Coast Highway easterly of said ramp to the driveway
27 approximately 65 feet east of power pole No. 824187E.
28 BE IT FURTHER RESOLVED that the traffic engineer be
29 authorized and directed to sign and mark said area indicating that
30 parking is prohibited as provided in Section 3272 of the Newport
31 Beach Municipal Code.
32 Any provision of this resolution which regulates traffic

or delegates the regulation of traffic upon state highways in any
way for which the approval of the Department of Public Works is
required by state law, shall cease to be operative six months
receipt by the City Council of written notice of withdrawal of
approval of the Department of Public Works.
Whenever this resolution delegates authority to a city
officer, or authorizes action by the City Council to regulate
traffic upon a state highway in any way which by state law
requires the prior approval of the Department of Public Works, no
such officer shall exercise such authority nor shall such action
by the City Council be effective with respect to any state highway
without the prior approval in writing of the Department of Public
Works when and to the extent required by Division 9 and Division
11 of the Vehicle Code.
This resolution was adopted by the City Council of the
City of Newport Beach at a regular meeting on the 24th day of
August, 1959, by the following vote, to wit:

regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 24th day of August f 19 59 by the following
