OF I3EPTFORT BEACH ACCEPTING A UTILITY EASEMER7T

4 WHEREAS, The Irvine Company, a West Virginia corporation,)
5 and Back Bay Park, a California corporation, Lessee, have executed
6 a utility easement granting to the City of Newport Beach an ease-
1 ment twelve (12) feet in width for the purpose of constructing,
8 operating and maintaining a water main, water meter and appurte -.
9 nances over the real property in the City of Newport Beach, County
10 of Orange, State of California, lying in a portion of Block 94,
11 Irvine's Subdivision, as shown on map recorded in Miscellaneous
12 Record Maps Book 1, page 88, records of Orange County, California,
13 and lying six (6) feet on each side of the following described cen-
14 ter line:

Beginning at the intersection of the southeasterly
prolongation of the line of Mean High Tide as
16
established in Superior Court Case No. 20436,
between Stations 16 -B and 17, said line also being
17
the Boundary Line of the City of Newport Beach, and
the northeasterly line of Coast Highway, ORA- X60 -B,

100.00 feet wide; thence North 49 56 West,
329.96 feet to a point of tangent with a curve
19
concave to the southwest, thence northwesterly
along said curve through a central angle of

7° 151 47 ". a distance of 259.86 feet to the
intersection with a radial line having a bearing

of North 320 48' 13" East, which intersection is
the true point of beginning; thence North

Reserving unto the Grantors, their successors and assigns
the right to construct, maintain and operate lines of any
and all kinds across, under or over said easement or any
part thereof, including lines for the conveyance of water
and including lines for telephone, telegraph and electric
power, and the right to construct and maintain a private
street, but so as not to interfere with the reasonable
use for a water easement as described above.
Subject to all existing easements, reservations, rights
and rights of way of record;
Zv MZZAS, it is to the interest of the City to accept
utility easement for such purposes;
NMT, THEREFORE, BE IT RESOLVED by the City Council of

the City of Newport Beach that said utility easement be accepted
and the City Clerk is authorized and directed to execute and attach
a certificate of acceptance and consent to the recording of said
utility easement in the County Recorders office.
This resolution was adopted by the City Council of the
City of Newport Beach at a regular meeting an the 23A-o tday of
1960, by the following vote, to wit:

I, MARGERY SCHROUDER, City Clerk of the City of Newport
Beach, California, do hereby certify that according to the records
of the City of Newport Beach filed and maintained in my office,
the foregoing Resolution No. 5169 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 23rd day of February 19 60 by the following
vote, to wit:
AYES, COUNCILMEN: Kingsley, Atkinson, Higbie, Stoddard,
Hart, Lorenz, Somers
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: None
