NEWPORT BEACH ORD]ERING.THE VACATION, CLOSING UP
' 3 AND ABANDONMENT OF A PORTION OF AN ALLEY RUNNING
NORTHERLY FROM.SHORT STREET BETWEEN NEWPORT
4 BOULEVARD AND CLUBHOUSE AVENUE

WHEREAS, the City Council of the City of Newport Beach
7
did, on the 8th day of February, 1960, pass its certain Resolution
8
of Intention No. 5164, declaring its intention to order the
9
vacation, closing up and abandonment of a portion of a certain
10
alley running northerly from Short Street between Newport Boulevar
11
and Clubhouse Avenue in the City of Newport Beach, hereinafter mor
12
particularly described, pursuant to and in accordance with the
13
"Street Vacation Act of 1941x', and all amendments thereto, being
14
Sections 8300 to 8331, inclusive, of the Streets and Highways Code
15
of the State of California; and
16
WHEREAS, the Street Superintendent of the City of
17
Newport Beach has caused to be posted conspicuously along the
18
line of the portion of said alley proposed to be vacated, not
19
more than 300 feet apart, and not less than three in all, notices
26
of the vacation of said portion of said alley, all of which will
21
more fully appear from the affidavit of L. W. Covert, Street
22
Superintendent of the City of Newport Beach, on file in these pro-
23
ceedings; and
24
WHEREAS, said notices so posted by the Street Superin-
25
tendent of the City of Newport Beach stated the passage of said
26
Resolution of Intention No. 5164 aforesaid, and the time and place
27
of the hearing of all persons interested in or objecting to the
•
28
proposed vacation of said portion of said alley; and
•
29
WHEREAS, the City Council of the City of Newport Beach
30
did set Monday, March 14, 1960, at 7:30 P. M. of said day as the
31
time, and the Council Chamber of the City Council of the City of
32
Newport Beach, located in the City Hall of the City of Newport

Beach, as the place, for the hearing of all persons interested in

or objecting to the proposed vacation of said portion of said alley

WHEREAS, said Resolution of Intention No. 5164 aforesaid
5
has been.published at least once in the Newport Harbor News Press,
6
a newspaper of general circulation, printed, published and circu-
7
lated in the City of Newport Beach, and said publication was made
8
more than 15 days prior to the date set for the hearing of all
9
persons interested in or objecting to the proposed vacation, all
10
of which will more fully appear by the affidavit of Ben Reddick,
11
owner and publisher of said Newport Harbor News Press, on file in
12
these proceedings; and

WHERZAS, the City Council of the City of Newport Beach
14
has heard the evidence, both written and oral, of all persons
15
interested in the vacation of said portion of said alley in this
16
resolution more particularly hereinafter described, and finds from
17
all the evidence submitted that said portion of said alley describe
18
in said Resolution of Intention, and.hereinafter described, is un-
19
necessary for present or prospective public street purposes;
20
NOW, THEREFORE, the City Council of the City of Newport
21
Beach finds and determines and hereby orders that the following
22
described portion of that certain alley running northerly from
23
Short Street between Newport Boulevard and Clubhouse Avenue in the
24
City of Newport Beach, to wit:

That portion of the alley 10 feet in width adjacent to
Lot 7, Block 634, as shown upon a map of Canal Section,
26
recorded in Miscellaneous Maps, Book 4, page 98, records
of.Orange County California, and more particularly
27
described as follows:

Beginning at the most southerly corner of said
Lot 7; thence southeasterly along the southeast-

29
erly prolongation of the southwesterly line of
said Lot 7, 2.27 feet, more or less, to an inter -
30
section with the easterly line of State Highway
ORA -43, said easterly line being a curve concave
31
to the east and having a radius of 1045.00 feet;
thence along said curve in a northerly direction

11.59 feet, more.or less, to the intersection

with the easterly line of said Block 634, Canal
Section; thence southerly along said easterly
line to the point of beginning,
is unnecessary for present or prospective public street purposes,
and that it be vacated, closed up and abandoned.
The City Council further finds and determines, and it is
hereby ordered, that the public easement in the portion of said
alley as heretofore described has, upon the passage of this resole
tion, ceased.
The City Council further orders that the City Clerk of
the City of Newport Beach shall cause a certified copy of this
Order, duly attested by her as the City Clerk, under the seal of
the City, to be recorded in the office of the County Recorder of
the County of Orange, State of California, immediately following
the passage of this resolution.
