2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT, BEACH "ACCEPTING A,RELINQUISHMENT_OF
3 ACCESS RIGHTS

5 WHEREAS, Pacific Electric Railway Company, a corporation,
6 is the owner and subdivider of real property in the City of Newport
7 Beach, County of Orange, State of California, described as:
8 Lots 1 through 83 of Tract 4400, per map recorded
in Book , , of Miscellaneous Maps,
9 in the oTiceof the—Co—My Recorder of said Orange
County;

11 and
12 WHEREAS, the Final Map of Tract 4400 was approved by the
13 City Council subject to the condition that vehicular access be
14 prohibited to State Highway 101 ®A from-said Lots 1 through 83 of
15 said tract; and
16 WHEREAS, Pacific Electric Railway Company has executed
17 and delivered to the City of Newport Beach a Relinquishment of
18 Access Rights which meets said condition imposed by the City Counci
19 in approving said Final Map; and
20 WHEREAS, it appears to be in the best interests of the
21 City of Newport Beach to accept said instrument;
22 NOW, THEREFORE, BE IT RESOLVED that said Relinquishment o
23 Access Rights-be accepted and the City Clerk is authorized and
24 directed to execute and attach a certificate of acceptance and
25 consent to the recording of said document in the County Recorder's
26 office.
