RESOLUTION NO. 5611
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN
3 AGREEMENT WITH JOHN B. KILROY AND REJAC CORP.,
SUBDIVIDERS, FOR THE CONSTRUCTION OF_INPROVEMEINTS
4 IN. THE EXTENSION OF DANA ROAD AND FLAGSHIP ROAD

6 �`IHuRREAAS, there has been presented to the City Council of
7 the City of Newport Beach an agreement in which John B. Kilroy and
8 Rejac Corp., a California corporation, subdividers of Tract No.
9 4692, agree to construct street and other public improvements on
10 the right -of»way conveyed to the City for the extension of Dana
11 Road to the intersection of the extension of Flagship Road, as both
12 of said roads are shown on the map of Tract No. 4692; and
13 WHEREAS, subdividers have furnished security to assure
14 the faithful performance under said agreement in accordance with
15 the Newport Beach Municipal Code; and
16 WHEREAS, the City Council has reviewed said agreement
17 and found the same to be fair and equitable and in accordance with
18 the provisions of the Code;
19 NCW$ THEREFORE, BE IT RESOLVED that the Mayor and City
20 Clerk be and are hereby authorized and directed to execute the
21 same on behalf of the City of Newport Beach at such time as said
22 security is approved by the City Manager as to sufficiency and
23 the City Attorney as to form.
