MM=n S, the City `;ouncil of the City of Newport 2_,each

did, on the 24th day of September, 1962, pass its certain 51esolution
7
of Intention No. 5671, declaring its intention to order the vacation
8
closing up and abandonment of a portion of a certain street 1MMm
9
as Bayside give in the City of Neirport Peach, hereinafter more
10
particularly described, pursuant to and in accordance with the
11
TOStreet Vacation Lct of 194109, and all amendments thereto, being
12
sections 8300 to 8331, inclusive, of the Streets and Highwaya Code
13
of the State of California; and
14
vF7,M,=_,3-, the Street Superintendent of the City of Newport
15
Beach has caused to be posted conspicuously along the line of the
16
portion of said street proposed to be vacated, not more than 300
17
feet apart, and not leas than three in all, notices of the vacation
18
of said portion of said street, all of which will more fully appear
19
from the affidavit of Donald C. Simpson, Street Superintendent of
20
the City of Newport ,Peach, on file in these proceedings; and
21

tendent of the City of Newport Peach stated the passage of said .

Resolution of Intention No. 5671 aforesaid, and the time and place
24
of the hearing of all persons interested in or objecting to the
25
proposed vacation of said portion of said street; and

c`!M'ZLS, the ',ity Council of the City of Newport Peach
27
did set Tuasday, November 13, 1962, at 7030 P. K. of said day as the
28
time, and the Council Chamber of the City Council of the City of
29
Newport Beach, located in the City Fall of the City of Newport
30
Peach, as the place, for the hearing of all persons interested in
31
or objecting to the proposed vacation of said portion of said
32
street; and

[= Rif's, said Resolution of Intention No. 5671 aforesaid

has been published at least once in the Neenport Harbor Ensign, a
3
newspaper of general circulation, printed, published and circulated
4
in the City of Newport Beach in the manner prescribed by law for
5
the publishing of ordinances of the City, all of which will more
6
fully appear by the affidavit of Arvo 2. Haapa, owner and publisher
7
of said Newport Harbor Ensign, on file in these proceedings; and
8

has heard the evidence, both written and verbal, of all persons
10
interested in the vacation of said portion of said street in this
11
resolution more particularly hereinafter described, and finds from
12
all the evidence submitted that said portion of said street de-
13
scribed in said ?. esolution of Intention, and. hereinafter described,
14
is unnecessary for present or prospective public street purposes;
15
NTNT, THMIE 'ORZ, the City Council of the City of P?ecnoort

Beach finds and determines and hereby orders that the following
17
described portion of that certain street known as Bayside Drive in
18
the -City of Nevm ort Beach, to wit:

That portion of land in the County of Orange,
Mate of ,alifornia, described in the deed to the
20
County of Orange, recorded March 15, 1957, in
Book 3839, Page 88, of Official Records, in the
21
office of the county Recorder of Orange ;County,
:allfornia,
22
MCEPT that portion thereof lying westerly of a line
23
between stations 16A and 16D of the Ordinary Migh
Tide line established in 1926 by Count Decree No.
24
20436 of The superior Court of Orange County,
25
tLSO =EPT that portion thereof lying northerly
of the westerly line of the 80-foot wide nayside
26
Drive =load right of way as recorded in Book 4288,
Page 216 of Official Records in the office of said

Orange County 'Recorder,
28 is unnecessary for present or prospective public street purposes,
29 and that it be vacated, closed up and abandoned.
30 The City Council further finds and determines, and it is
31 hereby ordered, that the public easement in the portion of said
32 street as heretofore described. has, upon the passage of this

resolution, ceased.

The City Council
further orders that the City Clerk of

the City of Fewport Beach shall cause a certified copy of this
4
Order, duly attested by her
as the City Clerk, under the seal of
5
the City, to be recorded in
the office of the County 2ecorder of

the County of Orange, State
of California, immediately following
7
the passage of this resolution,
