RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, ASCERTAINING
• AND DETERMINING THE PREVAILING RATE OF WAGES
TO BE PAID FOR THE IMPROVEMENT IN RIVER AVENUE,
ALLEY AND CERTAIN OTHER STREETS AND EASEMENTS
IN SAID CITY
WHEREAS, the City Council of the City of Newport Beach,
California, did on the 26th day of November, 1962, adopt its
Resolution of Intention No. 56931 and
WHEREAS, pursuant to the provisions of Section 1773 of
the Labor Code of the State of California, it is necessary that
the City Council of the City of Newport Beach ascertain and
determine the general prevailing rate of wages on public works,
and the provisions of said Code make it mandatory upon the
awarding body of any public contract where said body subsequently
calls for bids for any public improvement to ascertain and determine
the general prevailing rate of per diem wages in the locality in
which the work is to be performed, for each craft or type of workman
or mechanic needed to execute the contract, and also the general
prevailing rate for legal holiday and overtime work in each craft
or type of workman or mechanic.
%£ NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That it, the said City Council of the City
of Newport Beach, has ascertained and does hereby determine that
the general prevailing rate of per diem wages in the locality
in which said work described is to be performed in the matter
of the construction of certain improvements in River Avenue,
Alley and certain other streets and easements, in said City, for

each craft or type of workman or mechanic needed to execute
the contract, and also the general prevailing rate for legal
holiday and overtime work for each craft or type of workman
. or mechanic, is in accordance with the schedule attached hereto.
Any classification omitted herein shall be paid not
less than $2.68 per hour.
Holiday, Sunday and overtime employment is not usually
permitted, but if allowed, wages shall be one and one -half times
the above rates.
The rates of wages, including overtime, holiday and
Sunday rates, as just specified, are subject to the effect, if
applicable thereto, of executive orders of the President of the
United States No. 9240, dated September 9, 1942, and No. 9350,
dated October 3,. 1942,, to any modifications thereof and to any
and all lawful orders of the President or any other authorized
Federal officer or agency, insofar as the same may be applicable
to this contract. In case of any inconsistency or omission,
the rates fixed by any such applicable Federal order, whether
higher or lower, shall control.
In accordance with the provisions of Section 1777.5 of
the Labor Code, as amended by Chapter 971, Statutes of 1939s
and in accordance with the regulations of the California
Apprenticeship Council, properly indentured apprentices may be
employed in the prosecution of this work.
The above listed rates are based upon a working day
of eight (8) hours, being proportionately applicable to
eight (8) hours or less of employment in any one calendar day
other than Saturdays, Sundays and the following seven legal
holidays: New Year's Day, Memorial Day, Fourth of July, Labor
Day, Armistice Day, Thanksgiving Day and Christmas, where any
work is required in case of extra - ordinary emergency caused by
fire, flood or danger to life or property. For any working
time of more than eight (8),hours in any one calendar day and
for time worked on Saturdays, Sundays and any of the afore-
mentioned holidays, not less than one and one -half times the
specified rates shall be paid.

Los Angeles, Orange, Riverside, San Bernardino, Imperial, Ventura, Santa Barbara, San Luis

All operators and oilers on equipment with booms of 80 to 100 feet, including
jib and pile driving rigs with hamiaer leads of 80 to 100 feet, shall receive 15¢ per
hour premium pay additional to the regular rate of pay. Thereafter they shall receive
an additional. 100 per hour premium pay additional to the regular rate of pay for
each additional 20 feet of boom, including jib.
It is agreed that two or more Engineer Operators will constitute a complete
operating crew on all. Tower Crane equipment (American Pecco, Bucyrus Erie; Piayco-
Weitz, Linden and Similar types), and they shall receive 450 per hour premium pay in
addition to the applicable Universal Equipment Operator's rate of pay (Long Boom
premium shall not apply to this equipment).
Operators on all hoisting equipment with three drums or more, shall receive 150
per hour premium pay additional to the regular rate of pay.
Combination Mixer and Compressor Operators on Gunite work shall be classified as
Concrete iiobile iiixer Operator.
Operators on Equipment with scrapers or dragtype shovels in tandem shall receive
premium pay of .$pl,00 per hour above the regular rate.
The necessity for the use of an employee as a Signalman shall be determined by
the Contractor. When used, he shall be an Engineer - Oiler, as defined herein, who
assists in giving or relaying signals by mechanical means (also by means of hand
signals on excavation work) directly to the Operator of hoisting equipment only.
On a survey crew the Party Chief shall receive premium pay of 100 per hour
above the regular rate.
All classifications employed in a tunnel, receive 250 per hour premium pay
additional to their regular rate of pay.
