A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH INITIATING PROCEEDINGS TO EXCLUDE
A PORTION OF UNINHABITED TERRITORY ANNEXED TO
THE CITY AS UNINHABITED TERRITORY ON ITS OWN
MOTION AND GIVING NOTICE THEREOF
WHEREAS, the City annexed certain uninhabited territory
in 1957 by City Ordinance No. 837 known as "Acacia Street Annex ";
and
WHEREAS, a portion of Acacia Street which bounds said
territory on the northwest has been realigned, thereby severing a
portion of said territory and placing said portion of said terri-
tory in a location where it is not oriented with development
within the City; and
WHEREAS, it appears to be in the best interests of the
owner of said land, the County of Orange, and the City of Newport
Beach and its citizens to exclude the portion of said territory
hereinafter described from the City of Newport Beach;
NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED, and RESOLVED-
Section 1, The City Council of the City of Newport Beach
hereby initiates proceedings on its own motion to exclude a portion
of uninhabited territory annexed to the City as uninhabited terri-
tory, which portion is particularly described as follows, to wit:
That portion of lot 139, block 50 of Irvine's Subdivision
in the City of Newport Beach, County of Orange, State of
California, as said subdivision is shown on a map recorded
in Book 1, page 88 of Miscellaneous Record Maps in the
office of the County Recorder of said county described as
follows-
Commencing at the most northerly corner of Tract No. 3201
as per map recorded in Book 130, pages 25 to 30 inclusive,
of Miscellaneous Maps, records of Orange County; thence
North 390 48' 15" East 108,82 feet along the southeasterly
right of way line of Acacia Street, 70 feet wide, as shown
on said tract map, said southeasterly right of way line
being also the northwesterly line of the Acacia Street Annex
to the City of Newport Beach as described in Ordinance No.
837 of said city to an intersection with a non - tangent curve
concave southeasterly having a radius of 1200 feet, said
intersection being the true point of beginning, a radial to
said point bears North 35° 21' 39" West; thence continuing
North 39° 48'-15" East 377,58 feet along said southeasterly
right of way line and said northwesterly line of the Acacia
Street Annex to an intersection with the westerly right of
way line of MacArthur Boulevard, 110 feet wide, as described
in a deed recorded in Book 1047, page 557 of Official Records,
records of Orange County; thence South 70 50° 38" East 150.49
feet along said westerly right of way line being also the
easterly line of said Acacia Street Annex to an intersection
with said non - tangent curve concave southeasterly having a
radius of 1200 feet, a radial to said intersection bears
North 210 07` 16" West; thence leaving said westerly right
of way line and said easterly line of the Acacia Street
Annex, southwesterly 298.24 feet along said curve through an
angle of 140 14° 23' to the true point of beginning.
Section 2. The reasons for desiring exclusion are;
Recently and subsequent to the annexation of uninhabited
territory by Ordinance No. 837, Acacia Street in the County of
Orange near its intersection with MacArthur Boulevard has been
realigned and has separated a portion of said territory annexed
by Ordinance No. 837 from the remainder thereby annexed. Said
portion so separated, containing .43 acres, more or less, is not
now oriented with development within the City of Newport Beach
but on the contrary is more closely oriented with development of
the Orange County Airport owned and operated by the County of
Orange. The City Council finds and determines that it would be
in the best interests of the landowner, the County of Orange, and
the City of Newport Beach and its citizens to exclude said portion
hereinabove described from the City of Newport Beach.
Section 3. The Public Works Director of Newport Beach
shall cause the specific legal description of the boundaries of
the territory hereby proposed for exclusion, including a map
thereof, to be submitted to the County Boundary Commission for,a
report as to the definiteness and certainty of its boundaries.
Section 4. The City Clerk shall cause a copy of this
resolution to be submitted to the Board of Supervisors of Orange
County and a copy to be published in the official newspaper of the
City for two successive weeks.
