RESOLUTION NO. 5796
A RESOLUTION OF THE CITY COUKCIL OF THE CITY OF
NEWPORT BEACH PRO`UIDING FOR PARKING PASSES AND
ESTABLISHING FEES FOR THE USE OF TIME BALBOA
PARKING LOT
WHEREAS, the City has a parking lot southerly of Ocean
Front at Pala Street and Washington Street in Balboa; and
WHEREAS, the City Council finds that passes should be
provided and parking fees should be charged for the use of such
lot as hereinafter provided;

10 Parking control shall be maintained on the Balboa
Parking Lot and a daily parking fee shall be charged for using such
lot, as follows
(a) The City Naanager shall establish the control
and begin charging the fee each year on .dune 1, or there-
after on the date he determines that there is a need for
parking control on the lot and the demand for parking will
justify maintaining attendants thereon, and shall discon-
tinue the control and fees on the day after Labor. Day_. or
on any subsequent date during the month of September when
he determines that the control is no longer necessary and
the demand for parking does not justify maintaining attend-
ants on said lot.
(b) Each day parking control is maintained on the
Balboa Parking Lot, the parking fee for each vehicle shall
be 254 pea hour with a maximum of 504.
(c) In order to encourage use of the lot by persons
shopping in the area, no fee shall be charged for the first
two hours of parking upon the presentation of a validated
.parking slip, Such validation mast be by a place of busi-
ness in the vicinity of the lot and in accordance with a
validation plan which shall be established by the City

Manager; provided, however, that such plan shall provide
that no purchase shall be required to obtain the validation.
2. The City Manager is hereby authorized and directed
to maintain parking control and charge fees not to exceed the
daily fees herein established after the date the controls and fees-
have been discontinued and prior to the date they are begun for the
following simmer season on days when there are special circumstances
which result in a need for parking control on the Balboa lot in
order to assure orderly and efficient use of the lot.
The City Manager is also authorized to waive the fees
established herein where a special event is being held of a
charitable or civic nature and it is in the interest of the City
and the general public that fees not be charged for the use of
the parking lot in connection with said special event.
After the daily control is discontinued in the fall and
prior to the date the control is imposed in the summer, the City
Hanger is authorized to accept a lump sum payment from a business-
man or businessmen in the area of the Balboa Parking Lot as compen-
sation for opening the lot to unrestricted public parking for a
particular event or events being held in the vicinity of the lot
in lieu of the surges that may otherwise be imposed.
3. Annual vehicle passes for the use or the parking
facilities on the Balboa lot are hereby established and shall be
made available to the public each calendar year. The fee for
such pass, which is nontransferable and may be used only for the
vehicle for which it is sold, shall be $7.59 per year per vehicle.
A transferable pass shall also be made available. The fee for the
transferable pass, which may be used for any vehicle, shall be $15
per year per vehicle. Lach such ;pass, when displayed in the wind -
