A RESOLUTION OF INTENTION OF THE CITY COUNCIL
OF THE, CITY OF NE%iPORT.BEACH DECLARING ITS
INTENTION. TO ORDER THE CLOSING UP, VACATION
AND ABANDOITMENT ..OF A. CERTAIN ALLEY IN BLOCK
11 -OF SEASHORE.COLONY TRACT
The City Council of the City of Newport Beach, pnnrsuant
to the provisions of the "Street placation Act of 1941 ", and all
amendments thereto, being Sections 8300 to 8331, inclusive, of
the Streets and Highways Code of the State of California, does
hereby resolve and declare as follows:
SECTION 1. The public interest and convenience require
the closing up and abandonment of a certain alley in Block 11 of
Seashore Colony Tract in the City of Newport Beach, and it is the
intention of the City ;ouncil of the City of Newport Beach to order
the following described alley in the City of Newport Beach, County
of Orange, State of California, to be vacated, closed up and aban-
doned, to wit:
Beginning at the intersection of the Northwesterly Line
of the 10.00 foot alley in Block 11, Seashore Colony
Tract, as shown on a Map thereof, Recorded in Book 7,
Page 25 of Miscellaneous Maps, Records of Orange County,
California, with the Southwesterly line of the North-
easterly one -half of Lot 12 in said Block 11; thence
North 350 51' 00" East along the Southeasterly line of
Lots 12, 11, 10 and 9 in said Block 11 and along the
Southeasterly line of Lot 1, Block G. E1 Moro Tract, as
shown on a Map thereof, Recorded in Book 8, Page 75 of
Miscellaneous Maps, records of said Orange County, a
distance of 169.98 feet; thence South 27° 35' 05t' East,
11.18 feet to the Southeasterly line of the said 10.00
foot Alley, said Southeasterly line being the Northwest-
erly line of Lots.3 4, 5, 6, 7 and 8 in said Block 11;
thence South 35° 51' 00" T3est along the said Northwest-
erly line, a distance of 164.98 feet to the Southwesterly
line of the Northeasterly one -half of said Lot 3; thence
North 54° 08' 00" 1•dest 10.00 feet to the point of beginning.
All of said alley to be vacated, closed up and abandoned
is more clearly shown on a certain map approved and adopted by the
City Council of the City of Newport Beach for said vacation,
closing up and abandonment, by resolution dated July 22, 1963, and
designated "Resolution No. Ng /L °', which said map is on file in

the office of the 0ity Clerk of the City of Newport Beach. Refer -

ence is hereby made to said map for further particulars as to the

proposed vacation, closing up and abandonment of said alley, and
4
said map is made a part of this resolution by this reference to
5
the same extent and purpose as if it were incorporated herein in
6
full.

SECTION 2. The proceedings for the closing up and aban-
8
donment of the aforesaid alley shall be had and taken, and the
9
City Council of the City of Newport Beach hereby elects to proceed
10
under the provisions of the "Street Vacation Pict of 1941 ", and all
11
amendments thereto, being Sections 8300 to 8331, inclusive, of the
12
Streets and Highways Code of the State of California.

SECTION 3, The Street Superintendent of the City of
14
Newport Beach shall cause to be conspicuously posted along the line
15
of the alley proposed to be vacated not more than 300 feet apart,
16
but not less than three in all, notices of the vacation of said
17
alley. Said notices shall state the passage of this Resolution of
18
Intention and the time and place of the hearing of all persons
19
interested in or objecting to the proposed vacation of said alley.
20
Said notices shall be so posted at least ten days before the date
21
of said hearing, all as required by law.

SECTION 4. There is hereby reserved and excepted from
23
the vacation of said alley a permanent easement and right at any
24
time, or from time to time, to construct, maintain, operate,
25
replace, remove, and renew sanitary sewers and storm drains and
26
appurtenant structures in, upon, over and across said alley pro-
27
posed to be vacated and pursuant to any existing franchises or
28
renewals thereof, or otherwise, to construct, maintain, operate,
29
replace, remove, renew and enlarge lines of pipe, conduits, cables,
30
wires, poles, and other convenient structures, equipment and fix -
31
tures for the operation of gas pipe lines, telegraphic and telephone
32
1 lines, railroad lines, and for the transportation or distribution

of electric energy, petroleum and its products, ammonia, water,
and incidental purposes, including access and the right to keep
the property free from inflammable materials, and wood growth, and
otherwise protect the same from all ha2ards in, upon and aver the
said alley proposed to be vacated.
These vacation proceedings are taken subject to the
reservations and exceptions herein contained.
SECTION 5. Notice is hereby given that the City Council
of the City of Newport Beach does hereby fax Monday, the 12th day
of August, 1963, at the hour of 7:30 o'clock P. K. of said day, in
the Council Chambers of the City of Newport Beach, located in the
City Hall of the City of Newport Beach, as the time and place for
hearing all persons interested in or objecting to the proposed
vacation of said alley, and the City Council at said time and place
will hear the evidence offered by any person interested in the
vacation of said alley hereinbefore described.
SECTION 6. This Resolution of Intention shall be nub -
lisped at least once in the official newspaper of the City, and
said publication shall be made before the date set for the hearing
of all persons interested in or objecting to the proposed vacation.
ADOPTED this 22nd day of duly, 1963.
