A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ORDERING THE VACATION, CLOSING UP
AND ABANDONMENT OF A CERTAIN ALLEY IN BLOCK 11
OF SEASHORE COLONY TRACT
AREAS, the City Council of the City of Newport Beach
did, on the 22nd day of July, 1963, pass its certain Resolution
of Intention No. 5817, declaring its intention to order the
vacation, closing up and abandonment of a certain alley in Block
11 of Seashore Colony Tract in the City of Newport Beach, herein-
after more particularly described, pursuant to and in accordance
with the "Street Vacation Act of 1941 ", and all amendments there-
to, being Sections 8300 to 8331, inclusive, of the Streets and
Highways Code of the State of California; and
WHEREAS, the Street Superintendent of the City of New-
port Beach has caused to be posted conspicuously along the lines
of said alley proposed to be vacated, not more than 300 feet
apart, and not less than three,in all, notices of the vacation
of said alley, all of which will more fully appear from the affi-
davit of Donald C. Simpson, Street Superintendent of the City of
Newport Beach, on file in these proceedings; and
WHEREAS, said notices so posted by the Street Superin-
tendent of the City of Newport Beach stated the passage of said
Resolution of Intention No. 5817 aforesaid, and the time and place
of the hearing of all persons interested in or objecting to the
proposed vacation of said alley; and
WHEREAS, the City Council of the City of Newport Beach
did set Monday, August 12, 1963, at 7 :30 P. M. of said day as the
time, and the Council Chamber of the City Council of the City of
Newport Beach, located in the City Hall of the City of Newport
Beach, as the place, for the hearing of all persons interested in
or objecting to the proposed vacation of said alley; and
WHEREAS, said Resolution of Intention No. 5817 aforesaid
has been published at least once in the Newport Harbor News Press-
Daily Pilot, the official newspaper of the City, and said
publication was made more than 15 days prior to the date set for
the hearing of all persons interested in or objecting to the pro-
posed vacation, all of which will more fully appear by the affi-
davit of Wm. Wineska, Advertising Director of said Newport Harbor
News Press -Daily Pilot, on file in these proceedings; and
WHEREAS, the City Council of the City of Newport Beach
has heard the evidence, both written and verbal, of all persons
interested in the vacation of said alley in this resolution more
particularly hereinafter described, and finds from all the evidence
submitted that said alley described in said Resolution of Intention,
and hereinafter described, is unnecessary for present or prospective
public street purposes; and
WHEREAS, utility companies have been advised of the pro-
posed abandonment and no request has been made for the reservation
of utility easements and it appears that no utilities are located
within said alley;
NOW, THEREFORE, the City Council of the City of Newport
Beach finds and determines and hereby orders that the following
described alley in Block 11 of Seashore Colony Tract in the City
of Newport Beach, to wit:
Beginning at the intersection of the Northwesterly Line
of the 10.00 foot alley in Block 11, Seashore Colony
Tract, as shown on a Map thereof, Recorded in Book 7,
Page 25 of Miscellaneous Maps, Records of Orange County,
California, with the Southwesterly line of the North-
easterly one -half of Lot 12 in said Block 11; thence
North 350 51' 00" East along the Southeasterly line of
Lots 12, 11, 10 and 9 in said Block 11 and along the
Southeasterly line of Lot 1, Block G, E1 Moro Tract, as
shown on a Map thereof, Recorded in Book 8, Page 75 of
Miscellaneous Maps, records of said Orange County, a
distance of 169.98 feet; thence South 270 35' 05" East,
11.18 feet to the Southeasterly line of the said 10.00
foot Alley, said,Southeasterly line being the Northwest-
erly line of Lots 3 4, 5, 6, 7 and 8 in said Block 11;
thence South 35° 511 00" West along the said Northwest-
erly line, a distance of 164.98 feet to the Southwesterly
line of the Northeasterly one -half of said Lot 3;. thence
North 54° 08' 00" West 10.00 feet to the point of beginning,
is unnecessary for present or prospective public street purposes,
and that it be vacated, closed up and abandoned.
The City Council further finds and determines, and it is

hereby ordered, that the public easement in said alley as heretofore
described has, upon the passage of this resolution, ceased.
The City Council further orders that the City Clerk of
the City of Newport Beach shall cause a certified copy of this
Order, duly attested by her as the City Clerk, under the seal of
the City, to be recorded in the office of the County Recorder of
the County of Orange, State of California, immediately following
the passage of this resolution.
