XZ2j` A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ANNOUNCING A GENERAL MUNICIPAL ELECTION TO BE HELD ON THE 14TH DAY OF APRIL, 1964, SETTING FORTH THE OFFICES TO BE FILLED, ORDERING THE SUBMISSION OF TWO.PROPOSED.AMEND- MENTS TO THE CHARTER OF THE CITY OF NEWPORT BEACH TO BE SUBMITTED TO THE ELECTORS OF SAID CITY AT SAID GENERAL MUNICIPAL ELECTION, AND PROVIDING FOR THE OPENING AND CLOSING OF THE POLLS FOR SAID GENERAL MUNICIPAL ELECTION WHEREAS, the Charter of the City of Newport Beach requires a general municipal election to be held on the 14th day of April, 1964, for the election of three members of the City Council for regular terms of four years from the following districts, to wit: First District, Fifth District, and Sixth District; and WHEREAS, the City Council of the City of Newport Beach, in accordance with the provisions of Section 8 of Article XI of the Constitution of the State of California, on its own motion is pro- posing two amendments to the Charter of the City of Newport Beach to be submitted to the qualified electors of said City at the general municipal election to be held on Tuesday, the 14th day of April, 1964; NOW, THEREFORE, the City Council of the City of Newport Beach does hereby resolve, declare, determine and order as follows: SECTION 1. There shall be held in the City of Newport Beach on Tuesday, the 14th day of April, 1964, a general municipal election of the qualified electors of said City for the purpose of electing three members of the City Council from the following dis- tricts, to wit: First District, Fifth District, and Sixth District, for the full term of four years in accordance with the Charter of the City of Newport Beach. SECTION 2. At the said general municipal election to be held on Tuesday, the 14th day of April, 1964, there shall be sub- mitted to the qualified electors of the City of Newport Beach the following two proposed charter amendments, to wit: CHARTER AMENDMENT NUMBER ONE The exact form of the ballot proposition to submit pro- posed Charter Amendment Number One to the qualified electors of the City of Newport Beach, with the language enclosed by the lines appearing on the ballot, is as follows: PROPOSED CHARTER AMENDMENT NUMBER ONE: YES Shall Section 1005 of the Charter be amended to assure that no Councilman will be disqualified from serving as Councilman from his district for the remainder of the period of time for which he NO was elected or appointed because of redistricting? A cross ( +) placed in the voting square after the word "YES" as set out above shall be counted in favor of the adoption of the proposed charter amendment. A cross ( +) placed in the voting square after the word "NO" as set out above shall be counted against the adoption of the proposed charter amendment. Should proposed Charter Amendment Number One receive a favorable vote and be approved, Section 1005 of the Charter shall be amended to read as follows: "Section 1005. Districts. The City is hereby divided into seven districts, the names and respective boundaries of which.shall be as hereinafter in this Article provided. In 1959 and each fourth year thereafter the City Council shall appoint a committee to study and report to the City Council on the advisability of redistricting the City. -Upon receipt of any such committee report, and at any other time deemed necessary or desirable in order that the district. boundaries be fair and logical, the City Council may by ordinance change and redefine the boundaries of any or all of the seven districts herein established. The boundaries • so defined shall be established in such manner that the district shall, as nearly as practicable, constitute natural, areas of contiguous and compact territory and provide fair representation on the City Council. Any territory erea ter annexe to or conso i ate w th the City shall, at the time of such annexation or consolidation, be added by ordinance of the City Council to an adjacent district or districts." CHARTER AMENDMENT NUMBER TWO The exact form of the ballot proposition to submit pro- posed Charter Amendment Number Two to the qualified electors of the City of Newport Beach, with the language enclosed by the lines appearing on the ballot, is as follows: PROPOSED CHARTER AMENDMENT NUMBER TWO: Shall the Charter be amended to add Section 1402 (c) to authorize the City Council to sell and convey that parcel of City -owned real prop- YES erty on the south side of Bay Avenue between 18th and 19th Streets described as follows, to wit: Lot 6, Block 218, as shown upon a map of Section "B ", Newport Beach, recorded in Mis- cellaneous Maps, Book 4, page 27, Records of Orange County, California, together with a por- tion of Lot 4, Section 33, Township 6 South, Range 10 West, S.B.B. & M., bounded on the south by the northerly line of said Lot 6, on the north NO by the easterly extension of the northerly line of Lot 4 in said Block 218, on the east by the northerly prolongation of the easterly line of said Lot 6, and on the west by the easterly lines of Lots 3 and 4 of said Block 218? A cross ( +) placed in the voting square after the word "YES" as set out above shall be counted in favor of the adoption of the proposed charter amendment. 3. A cross ( +) placed in the voting square after the word "NO" as set out above shall be counted against the adoption of the proposed charter amendment. Should proposed Charter Amendment Number Two receive a favorable vote and be approved, Section 1402 (c) shall be added to the Charter to read as follows: "Section 1402 (c). Exception to Section 1402. Notwithstanding the provisions of Section 1402, the City Council may sell and convey that parcel of City - owned real property described as follows, to wit: Lot 6, Block 218, as shown upon a map of Section "B ", Newport Beach, recorded in Miscellaneous Maps, Book 4, page 27, Records of Orange County, California, together with a portion of Lot 4, Section 33, Township 6 South, Range 10 West, S.B.B. & M., bounded on the south by the north- erly line of said Lot 6, on the north by the easterly extension of the northerly line of Lot 4 in said Block 218, on the east by the northerly prolongation of the easterly line of said Lot 6, and on the west by the easterly lines of Lots 3 and 4 of said Block 218." SECTION 3. The ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used. SECTION 4. The City Clerk of said City is hereby author- ized, instructed and directed to procure, give, make and furnish any and all official ballots, notices, publications and printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 5. For the purpose of holding said general muni- cipal election, the City Council shall hereafter by resolution fix, establish and appoint voting precincts, polling places of the re- spective precincts, and the respective boards of election for said respective precincts. SECTION 6. All of the persons hereafter by resolution named and appointed as election officers shall receive compensa- tion in the amount of $21.00 for each Inspector, and $18.00 for each Judge and Clerk, for said election. The rental for each 4. polling place established where a charge is.made shall be the sum of $10.00 for said election. SECTION 7. The polls for said election shall be open at seven o'clock A. M. of the day of said election, and shall • remain open continuously from said time until seven o'clock P. M. of the same day, when said polls shall be closed, except as pro- vided in Sections 14436 and 14437 of the Elections Code of the State of California. SECTION 8. In all particulars not recited in this reso- lution, said election shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 9. The City Clerk of said City is hereby author- ized and directed to give notice of said election in the time, form and manner as required by law and to give any further or additional notice of said election in time, form and manner as required by law and to advertise said Charter Amendments in accordance with Section 8 of Article XI of the Constitution of the State of Cali- fornia and to perform such other acts as are necessary to conduct said election in accordance with law, and shall cause to be printed, on plain white paper, without watermarks, at least as many copies of the form of ballot provided and used in each voting precinct as there are voters in the precinct. Such copies shall be designated as "Sample Ballot" upon their face. Said City Clerk shall commence to mail one Sample Ballot, postage prepaid, to each voter not more than 40 nor less than 15 days before said 14th day of April, 1964. The mailing of said Sample Ballots shall be completed at least 10 whole days before said day of election. The number of such Sample Ballots printed shall not exceed the total registration by more than fifteen per cent (15 %). Said City Clerk shall also enclose • in the envelope with each of said Ballots arguments on measures and other matters required by law, including a card stating the location of the precinct's polling place of each voter. Only of- ficial matter shall be sent in such envelope. 5.
