A RESOLUTION OF INTENTION OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH DECLARING ITS
INTENTION TO ORDER THE VACATION OF A PORTION
OF A UTILITY EASEHENT IN THE VACATED PORTION OF
BEACON STREET BETWEEN LA JOLLA DRIVE AND CATALINA
DRIVE
The City Council of the City of Newport Beach, pursuant to
the provisions of the "Public Service Easements Vacation Law09 and
all amendments thereto, being Sections 50430, et seq., of the
Government Code of the State of California, does hereby resolve and
declare as follows:
SECTION 1. The public interest and convenience require,
land it is the intention of the City Council of the City of Newport
Beach to order, the vacation of all that certain easement for
utility purposes in the vacated portion of Beacon Street between
LaJolla Drive and Catalina Drive in the City of Newport Beach except
the following:
Parcel No. 1•
An easement for public utility purposes, 9.00 feet in width,
the northeasterly line of said easement being 5 feet north-
easterly of and parallel with the center line of Beacon
Street (formerly Twelfth Street) lying between the north-
easterly prolongation of the southeasterly line of Catalina
Drive (formerly Old County Road) and the northeasterly pro-
longation of the northwesterly line of La Jolla Drive
(formerly Smeltzer Avenue), as shown on a Map of Tract No.
444, recorded in Book 19,.page 29 of Miscellaneous Naps,
Records of Orange County, Californian said Beacon Street
vacated by Resolution No. 4564 of the City of Newport Beach,
a certified copy of which Resolution was recorded November
19, 1956 in Book 3715, page 488 of Official Records of said
Orange County. The side lines of said easement to be
lengthened or shortened to terminate on the said southeast-
erly line of Catalina Drive and the said northwesterly line
of La Jolla Drive.
Parcel No. 2:
An easement for public utility purposes 10.00 feet in width,
the northwesterly line of said easement being 58 feet north-
westerly of and parallel to the northeasterly prolongation
of the northwesterly line of said La Jolla Drive. The side
lines of said easement to be lengthened or shortened to
terminate on the northeasterly line of said vacated Beacon
Street, and on a line parallel with and 8.00 feet south-
westerly of the centerline of said vacated Beacon Street.

The portion of said easement to be vacated is shown on a
certain map entitled "Sketch showing division of Lot 2, Tract 444, &
Vacated Beacon St. (Adjacent), Newport Beach, Calif. ", being ,fob No.
3364 of .Tack S. Raub, Land Surveyor, dated Jan.7, 1964, revised
May 7, 1964, as Job No. 5428, a copy of which is marked Exhibit "A`
and attached hereto and by this reference made a part hereof, and
which shall be kept on file in the office of the City Clerk as a
part of this resolution.
SECTION 2. The proceedings for the vacation of said
portion of said easement are taken pursuant to, and the City Council
of the City of Newport Beach hereby elects to proceed under the
provisions of, the "Public Service Easements Vacation Law" and all
amendments thereto, being Sections 50430 to 50445, inclusive,of the
Government Code of the State of California.
SECTION 3. The Public Works Director of the City of
Newport Beach shall cause to be conspicuously posted along the line
of the portion of said easement proposed to be vacated, not more
than 300 feet apart and not less than three in all, notices of the
vacation of said portion of said easement. The notices shall state
the passage of this resolution of intention and the time and place
of the hearing before the City Council of all persons interested -Jr.
or objecting to the proposed vacation. Said notices shall be posted
at least ten days before the date of said hearing.
SECTION 4. Notice is hereby given that the City Council
of the City of Newport Beach does hereby fix Konday, the 22nd day o:l
June, 1964, at the hour of 7:30 o'clock P. K. on said day, in the
Council Chamber located in the City ;Iall of the City of Newport aeac
at 3300 Newport Boulevard, Newport Beach, California, as the time an
place for hearing all persons interested in or objecting to the pro-
posed vacation of said portion of said easement.
SECTION 5. A notice of the hearing hereinbefore set,
giving the date, time and place of said hearing, shall be published

by the City Clerk in the official newspaper of the City once each
week for at least two successive weeks prior to said hearing.
