RESOLUTION N0, 6076
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS INTENTION TO ANNEX
TO THE CITY CERTAIN PROPERTY KNOWN AS ANNEXATION
NO. 56 AND GIVING NOTICE THEREOF
WHEREAS, there is situated outside and contiguous to the
City of Newport Beach a certain uninhabited territory within the
meaning of the Annexation of Uninhabited Territory Act of 1939,
said territory being hereinafter more particularly described; and
WHEREAS, annexation to the City would make municipal ser-
vices available to the property owner and be%for the best interests
of said owner and the City of Newport Beach and its citizens; and
WHEREAS, the City of Newport Beach, as proponent, did on
or about the 30th day of July, 1964, submit to the Secretary of the
Orange County Boundary Commission a proposal for annexation with a
legal description and map•of the hereinafter described uninhabited
territory for its report, and filed said map with the Registrar of
Voters, pursuant to the provisions of Section 35002 of the Govern-
ment Code of the State of California; and
WHEREAS, the City of Newport Beach, as proponent, did on
or about the 30th day of July, 1964, submit to the Local Agency
Formation Commission a notice of intention to annex the hereinafter
described uninhabited territory, which notice contained the specific
boundaries of said.territory, pursuant to Section 54761 of said
Government Code; and
WHEREAS, on the 14th day of August, 1964, there was filed
with the City Clerk of the City of Newport Beach a report of said
Orange County Boundary Commission prepared pursuant to the provisions
of Section 35002 of said Government Code; and
WHEREAS, on the 21st day of September, 1964, there was
• filed with the City Clerk of the City of Newport Beach a report of
said Local Agency Formation Commission approving the proposed annex-
ation;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that proceedings are hereby initiated
pursuant to Section 35310 of the Government Code to annex said ter-
ritory hereinafter described, which territory is contiguous to the
present boundaries of said City and which said territory now is
uninhabited within the meaning of the Annexation of Uninhabited
Territory Act of 1939 and that the reasons for said annexation are
that it would make municipal services available to the property
owner and be in the best interests of said owner and the City and
its citizens that said City annex said territory.
NOTICE IS HEREBY GIVEN that it is proposed by said City
of Newport Beach to annex said hereinafter described territory to
said City, which said territory shall in these proceedings bear the
name of "ANNEXATION NO. 56 ". The specific description of the bound-
aries of the territory so proposed to be annexed is as follows-
That portion of Lot 139 and Lot 144, Blk. 50 of Irvine's
Subdivision in the County of Orange, State of California
as per map recorded in Book 1, Page 88 of Miscellaneous
Record Maps in the office of the County Recorder of said
county, described as follows:
Beginning at the most westerly corner of Lot 18,
Tract No. 5169 as per map recorded in Book 190,
Pages 11 to 13 inclusive of Miscellaneous Maps,
official records of Orange County; thence
N 390 48' 15" E 308.78 ft. along the northwest-
erly boundary line of said Tract No. 5169, said
boundary line also being the northwesterly line
of the Acacia Street Annex to the City of Newport
Beach as described in Ordinance No. 837 of said
city, to an intersection with a non - tangent curve
concave southeasterly having a radius of 1200 ft.
a radial to said curve at said intersection bears
N 350 21' 38" W, said intersection also being the
southwesterly corner of that certain "uninhabited
territory" excluded from the City of Newport Beach
as described in Ordinance No. 1036 of said city;
thence southwesterly 310.71 ft. along said curve
through a central angle of 14° 50' 07" to a tangent
line parallel with and northwesterly 40 ft. from
the northwesterly boundary line of Tract No. 3201
as per'map recorded in Book 130 Pages 25 to 30
inclusive of said Miscellaneous Maps; thence
S'390 48' 15" W 4031.55 ft. along said parallel
line to the northwesterly prolongation of the south-
westerly boundary line of said Tract No. 3201;
thence S 50° 12' 00" E 40 ft. along said prolonga-
. tion to the most westerly corner of said Tract No.
3201; thence N 390 48' 15" E 4030.02 ft. along the
northwesterly boundary line of said Tract No. 3201
to the point of beginning.

FURTHER NOTICE IS HEREBY GIVEN that on Monday, the 25th
day of January 1965, at the hour of 7:30 P. M. on said day, or
as soon thereafter as the matter may be heard, in the Council
Chamber of the City Hall of the City of Newport Beach, 3300 Newport
Boulevard, Newport Beach, California, a hearing will be had, at
which hearing the City Council shall hear and pass upon all written
protests filed at any time prior to the final adjournment of the
hearing by any person owning real property within the territory pro-
posed to be annexed, and at any time prior to said final adjournment
any owner of property within the territory proposed to be annexed
may file a written protest against the annexation. The protest
shall set forth the name of the owner of the property affected and
give a description of the said property in general terms.
The City Clerk of the City of Newport Beach is hereby
authorized and directed to cause a copy of this resolution to be
published once a week for two weeks, said publication to be com-
plete at least twenty (20) days prior to the date set for the hear-
ing, and the publication shall be in the official newspaper of the
City, which is a newspaper of general circulation published in the
City of Newport Beach, and in-Ehe Register
, a newspaper of general circulation
published in the County of Orange and outside the City of Newport
Beach.
The,City Clerk is further authorized and directed to mail,
not less than 20 days prior to the date set for the hearing, a.
notice of .the proposed annexation to each person to whom land within
the territory proposed to be annexed is assessed in the last avail-
able equalized county assessment roll, at the address shown thereon
or as known to said City Clerk, and to others who have requested
• the same in accordance with the provisions of the Annexation of Un-
inhabited Territory Act of 1939 as amended.
