2 A RESOLUTION OF INTENTION OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH DECLARING ITS
3 INTENTION TO ORDER AN 110ROVEMENT CONSISTING
OF THE INSTALLATION OF Si ET LIGHTING 11MPROVE-
4 PMTS AND APPURTENANCES IN PROPOSED ASS2SS T
DISTRICT NO. 50 (BALBOA ISLAND STREET LIGHTING
5 DISTRICT) AND SETTING THE TUM- AND PLACE FOR
HEARING PROTESTS THEREON

7 WHEREAS, on the 9th day of August, 1965, the City Council
8 ordered the Public Works Director of the City of Newport Beach to
9 prepare and file with the City Clerk a preliminary report concerning
10 the proposed formation of an assessment district to install street
11 lighting improvements and appurtenances on Balboa Island pursuant to
12 the provisions of the Street Lighting Act of 1919, Division 14, Part
13 1 of the Streets and Highways Code of the State of California; and
14 �JHEREAS, on the 23rd day of August, 1965, said preliminary
15 report was presented to the City Council for its consideration and
16 was approved by the City Council without modification; and
17 WHERMS, the City Council hereby finds that the public
18 interest and convenience require the formation of an assessment
19 district to provide for the installation of certain street lighting
20 improvements as hereinafter described;
21 NOV, THEREFORE, the City Council of the City of Newport
22 Beach does hereby resolve and order as follows:
23 1. That this City Council hereby declares its intention
24 to order the proposed improvement which is described as follows:
25 The installation of incandescent street lights and appurtenances in
26 the alleys of Balboa Island in the City of Newport Beach in the
27 approximate locations sho €n on the drawing marked ';exhibit "A " which
28 is attached hereto and by this reference incorporated herein.
29 2. That the said improvement shall proceed in accordance
30 with and under the tertts and conditions of the Street Lighting Act
V 31 of 1919, Division 14, Part 1 of the Streets and .Highways Code of
32 the State of California.

3. That the proposed assessment district shall be
I designated Assessment District No. 50 (Balboa Island Street Lighting
District) and the boundaries of said District shall be as sho= on
jexhibit "A" and are described as follows:
That portion of land generally known as Balboa Island in
the City of Newport Beach, County of Orange, State of
California, more particularly described as follows:
Beginning at the southeast corner of Block "A", Section
Five, Balboa Island, as per map recorded in.Book 8, page
9, of MUscellaneous Haps, Records of said County; thence
westerly parallel with the southerly line of Park Avenue
to the southwest corner of Lot "A ", Section Two, Balboa
Island, as per map recorded in Book 6, page 31, of said
Miscellaneous Flaps; thence continuing westerly, north-
westerly, northerly, northeasterly, easterly and south-
easterly along the boundary line of Lot "A ", Resubdivision
of Section One, Balboa Island, as per map recorded in Book
6, page 30 of said Piscellaneous Ydaps, and following the
same through all of its various curves and courses to the
northerly prolongation of the westerly line of Collins
Avenue, as shown on said last mentioned map- thence
easterly along the northerly line of Lot "P. Section
Three, Balboa Island, as per map recorded.in Book 7,
page 15, of said xiscellaneous Paps, and following the
same through all of its several courses to the northerly
prolongation of the westerly line of Onyx Avenue; thence
continuing easterly along the northerly line of said Lot
"B" and its easterly prolongation to the northwesterly
prolongation of the northeasterly line of Block "B ", sair!
Section Five; thence southeasterly along said northwest-
erly prolongation to the most northerly corner of said
Block "B "; thence southeasterly along said northeasterly
line of Block "B ", and following the same through all of
its various courses to the point of beginning.
4. That if any lots or parcels of land owned by the
City of Newport Beach are included within the proposed assessment
district, this City Council hereby declares its intention tImt all
of such land shall be omitted from the assessment hereafter to be
made to cover the costs of said improvement.
5. The improvement hereinabove described shall be for
Is period of twenty (20) years.
6. That Monday, the 25th day of October, 1965, at the
hour of 7:30 P.M., be and the same hereby is fixed as the day and
hour when all interested persons having filed a written protest may
appear at the Chambers of the City Council of the City of Newport
Beach, located at 3300 west Newport Boulevard, Newport Beach, Orange

County, California, and show cause why the City Council should not

order the proposed improvement to proceed.

7. That notice of the hearing hereinabove provided for

shall be given as follows:

(1) The Public Works Director is hereby directed to
6
cause to be posted along all streets in the district where the
7
improvement is proposed to be made or which is to be assessed
8
for the benefits thereof, at not more than three hundred feet
9
apart, but not less than three in ail, notices of the passage
10
of this resolution. The notice shall:
11
(a) be headed "notice of improvement ", in
12
letters of not less than one inch in height;
13
(b) in legible characters state the fact and
14
date of the filing of the report and the passage of the
15
resolution of intention;
16
(c) state the date, time and place fixed for
17
the hearing of protests;
18
(d) briefly describe the improvement proposed
19
to be made and refer to the resolution of intention and
20
report for further particulars.

The posting of the notices shall be completed at least ten (10)
22
days prior to the date fixed for hearing.
23
(2) The City Clerk is hereby directed to cause a
24
notice, similar in substance to the notice above described,
25
to be published by two successive insertions in the Newport
26
Harbor Ensign, such publication to be completed at least ten
27
(10) days prior to the date set for the hearing of protests.

8. That any interested person who objects to the pro -
29
posed improvement or to the assessment therefor may file a written
• 30
protest, stating his objections thereto, with the City Clerk at or
31
before the hour set for the hearing of protests. The City Clerk is
32
directed to indorse on every such protest the date and time of its

by her, and at the
time appointed
for the hearing shall

present to the City Council
all protests so
filed.
