RESOLUTION NO. 6630
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DETERMINING THAT THE PUBLIC INTEREST,
CONVENIENCE AND NECESSITY OF THE CITY OF NEWPORT
BEACH REQUIRE THE ACQUISITION OF CERTAIN REAL
PROPERTY FOR THE PURPOSE OF A PUBLIC STREET IMPROVE-
MENT, DECLARING THE INTENTION OF THE CITY TO ACQUIRE
SAID PROPERTY UNDER EMINENT DOMAIN PROCEEDINGS, AND
DIRECTING THE CITY ATTORNEY TO COMMENCE AN ACTION IN
THE SUPERIOR COURT FOR THE PURPOSE OF ACQUIRING SAID
REAL PROPERTY
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NEWPORT
SECTION 1. The public interest, convenience and neces-
sity of the City of Newport Beach and the inhabitants thereof
require the construction of a public improvement consisting of
the widening of 16th Street between Dover Drive and Irvine Avenue.
SECTION 2. The public interest, convenience and neces-
sity of said City and the inhabitants thereof require, for the
construction and completion of said improvement, the acquisition
by the City of a right of way and easement for street and highway
purposes in, over and on certain real property situated in the
City of Newport Beach, County of Orange, State of California, de-
scribed as follows:
PARCEL A>
That portion of Lot 148, Tract No. 1218, as per map
recorded in Book 37, pages 47 to 49 inclusive of
Miscellaneous Maps, records of Orange County, Cali-
fornia, described as follows;
Beginning at the most northerly corner of Lot 148;
thence southeasterly along the easterly line of Lot
148 to the intersection with a line parallel with and
42.00 feet southwesterly, measured at right angles,
from that certain centerline as described in Parcel
No. 1 in the deed to the City of Newport Beach,
recorded November 7, 1961, in Book 5905, Page 295.,
of Official Records; thence northwesterly along
said parallel line to the westerly line of said Lot
148; thence northeasterly along said westerly line
to the point of beginning.
PARCEL B:
That portion of Lot 3, Tract No. 1125, as per map re-
corded in Book 39, pages 7 and 8 of Miscellaneous
Maps, Records of Orange County, California, together
with that portion of 16th Street adjoining said lot
on the southwest as shown on said map and vacated
September 24, 1962 by Resolution No. 5669 of the City
Council of the City of Newport Beach, a certified
copy of which was recorded October 2, 1962 in Book
6269, Page 869 of Official Records, described as a
whole as follows;
A strip of land, 12.00 feet in width, the northeast-
erly line of said strip being parallel with and 30.00
feet southwesterly, measured at right angles, from
that certain centerline as described in Parcel No. 1
in the deed to the City of Newport Beach, recorded
November 7, 1961, in Book 5905, Page 295 of Official
Records.
Said 12.00 foot strip of land shall terminate north-
westerly on the westerly line of said 16th Street
(vacated per Resolution No. 5669) and shall terminate
southeasterly on the westerly line of Parcel No. 2 as
described in said deed recorded in Book 5905, Page 295
of Official Records.
PARCEL Co
That portion of Lot 3, Tract No. 1125, as per map re-
corded in Book 39, Pages 7 and 8 of Miscellaneous Maps,
Records of Orange County, California, described as
follows:
A triangular parcel of land bounded on the Northeast by
a line parallel with and 42.00 feet southwesterly,
measured at right angles, from that certain centerline
as described in Parcel No. 1 in the deed to the City of
Newport Beach, recorded November 7, 1961, in Book 5905,
Page 295 of Official Records; bounded on the Southeast
by the southwesterly line of Parcel No. 2 as described
in said deed and the westerly line of Dover Drive
(formerly 17th Street), 80.00 feet in width, as per
map of Tract No. 1125; and bounded on the southwest
by the arc of a circle having a radius of 25.00 ft.,
concave to the southwest, tangent to said parallel
line and tangent to said westerly line of Dover Drive.
SECTION 3. The public street improvement to be located
on the property described in Section 2 is located in a manner
which is compatible with the greatest public good and the least
private injury.
SECTION 4. The City Attorney of the City of Newport
Beach is hereby authorized and directed-
(a) To commence an action in the Superior Court in
the name and on behalf of the City against all owners and claim-
ants of the above described property, for the purpose of con-
demising and acquiring said property for the use of said City.
(b) To incur in the name of and on behalf of the City

of Newport Beach all obligations and expenses necessary to acquire
said property.
(c) To do such further acts and to take such additional
steps as may be necessary or convenient in connection with said
acquisition.
This resolution was adopted by at least a two- thirds
vote of the City Council of the City of Newport Beach at a
meeting of said Council on the 14th day of August, 1967, by the
following vote, to wit:

Gruber, Cook, Forgit, Shelton

City of Newport Beach, California, at a regular meeting of said City Council
held at the regular meeting place thereof, on the 14th day of August , 1967,
by the following vote, to wit:
