21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ACCEPTING AN EASEMENT FOR DEPOSIT
3 OF, STOF0 AND OTHER SURPLUS WATERS

51I WHEREAS, The Irvine Company, a West Virginia corpor-
6 ation, as owner, and Richard B. Smith, Inc., a California corpor-
7 ation, as lessee, have executed and delivered to the City of
8 Newport Beach an Easement for Deposit of Storm and Other Surplus
9 Waters which grants to the City an easement to deposit storm and
10 other surplus waters originating in the area delineated on
111 Exhibit "A" attached thereto, on and across the real property in
12 the City of Newport Beach, County of Orange, State of California,
13 described as:
14 Loa. B of Tract No. 6385, as shown on a map recorded
in Book 235, pages 1 to 5, of Miscellaneous Maps, in
15 the.office of the County Recorder of Orange County,
16 including the right to enter upon Lot B at any time that it may
17 see fit for maintenance of the drainage course and other purposes
18 more particularly set forth therein; and
19 WHEREAS, said document contains provisions for the con -
20 struction of certain permanent drainage facilities, maintenance
21 and protection of the drainage course, and the holding of grantee
221 harmless against claims, demands and judgments for damages to
23 third parties resulting from grantee's use of said easement; and
24 WHEUI AS, it is to the interest of the City to accept
25 said easement;
26 NOW, THEREFORE. BE IT RESOLVED that said Easement for
27 Deposit of Storm and Other Surplus Waters is accepted and the City
28 Clerk is authorized and directed to execute and attach thereto a
29 certificate of acceptance and consent to its recording and to
3a record said document in the County Recorder's office.

do hereby certify that according to the records of the City of Newport Beach
filed and maintained in my office, the foregoing Resolution No. FFFI was
duly and regularly adopted, passed, and approved by the City Council of the
City of Newport Beach, California, at a regular meeting of said City Council
held at the regular meeting place thereof, on the 9th day of October 1967,
by the following vote, to wit:
