A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING SUBMITTAL OF
APPLICATION(S) FOR ALL CALRECYCLE GRANTS FOR
WHICH CITY OF NEWPORT BEACH IS ELIGIBLE
WHEREAS, Public Resources Code sections 40000 et seq. authorizes
the Department of Resources Recycling and Recovery (CalRecycle), to administer
various Grant Programs (grants) in furtherance of the state of California's (State)
efforts to reduce, recycle and reuse solid waste generated in the State thereby
preserving landfill capacity and protecting public health and safety and the
environment; and
WHEREAS, in furtherance of this authority CalRecycle is required to
establish procedures governing the application, awarding, and management of the
grants; and
WHEREAS, CalRecycle grant application procedures require, among
other things, an Applicant's governing body to declare by Resolution certain
authorizations related to the administration of CalRecycle grants.
NOW, THEREFORE, the City Council of the City of Newport Beach
resolves as follows:
Section 1: The City Council of the City of Newport Beach authorizes
the submittal of application(s) to CalRecycle for all grants for which City of Newport
Beach is eligible;
Section 2: The Public Works Director, or his /her designee, is hereby
authorized and empowered to execute in the name of the City of Newport Beach all
grant documents, including but not limited to, applications, agreements, amendments
and requests for payment, necessary to secure grant funds and implement the
approved grant project;
Section 3: The authorizations established by this resolution are
effective for 5 fiscal years, Fiscal Years 2012/13 through 2016197.
Section 4: The City Council finds this action is not subject to the
California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in
the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential for resulting in physical change to the environment,
directly or indirectly.
Section S: This resolution shall take effect immediately upon its
adoption by the City Council, and the City Clerk shall certify the vote adopting this
resolution.
